e-brake light is messed up

my e-brake light is messed up...when i start the car in the morning...it stays on but later on it, the light turns off whenever it wants. happens a lot...i put my car in Drive and the e-brake is all the way down and the car still moves forward so i kno that the e-brake isn't really on...wat should i check?...i'm gonna check the fuse for it....but then wouldn't it just stay off if it was blown???...thanks

Could be sticking but giving enough play for the wheel to spin

Ever read your owners manual? It tells you that the BRAKE light will also warn you when your brake fluid level is low. Low fluid level is a sign of worn brake pads.

The reason it only comes on in the morning is because the system is cold. Cold fluid and components contract (gets smaller). As the day goes on and you drive the car the system gets warmer and expands (gets bigger). The fluid level is at it's lowest point when the system is cold and it's at it's highest point when the system is hot.

Don't just add fluid, check your pads, they are probably starting to get low.
