oil change - car damage

oil change - car damage

went to change oil in my maxima.
everything was ok until they tried to start my engine to check if everything is OK.
and then i hear some noises.
after few seconds owner calls me that my car hit the wall when a guy was trying to start engine.
they damaged my front bumper, both headlights, grill, hood lutch, A/C condenser.

what a ****ing day
i was told that they will fix it for free and rent a car for no fee

yes i went to shop to change it.
usually i do it, but due to cold weather i went to shop

In the real world that normal sensible people live in: They offered to fix it and give you a rental. If they make good on this then it's all good.

That's a lot of damage from hitting a wall 'trying to start the engine'. You need to get your *** down there and take pics before you authorize any work. Take pics of the wall where it crashed into. I've seen a geo metro rearend a jeep at 25mph and not do that much damage. You need to investigate and make sure they didn't have the car out on the road and cause an accident somewhere - it'd suck if they hit someone else and then that other person comes back and sues you (insurance goes with the car, not the driver) (if "and then i hear some noises." means that you were at the shop when it happened then you don't need to worry about that)

With that amount of damage if they offer to 'fix it themselves' instead of 'pay for the repairs' then you might want an independant shop take a look also, to make sure they are fixing everything.


Bear in mind that if you have made any modifications that would stop the clutch interlock from working properly, and the accident happened as they claim, then they likely owe you nothing because you defeated the safety device meant to protect against that.

i have a statement from them that accident was inside the shop, and it also says that they will cover all damage

1) take it to another dealer for a repair estimate to document all damage to make sure everything is fixed

If it makes you feel any better, years ago I got a new car for the first time in my life. It went to the selling dealer for it's first oil change ~2500 miles total on the odometer (didn't want to trust Jiffy Lube type places and figured a dealership would do a good job). They hit something, a wall or another car with the front bumper. They wanted me to leave without written documentation-just a verbal promise to fix it! They were slow to actually fix it-paint didn't match in appearance. They wouldn't give me a rental during the repair.

Like I posted, my car "just" had a cracked bumper. That's crazy damage! Get a 2nd estimate to document damage. My dealer promised the world to get me out of there and then was tough to deal with.

To me this sound like they did more than hit the wall. If you had frame damage, the must have hit it pretty damn hard. I would definitly get a quote from a trusty repair shop and see what they have to say. I honestly wouldnt have the garage where you got the oil changed fix it. Sue them and make them pay for repairs and a rental at a place you trust. After all, they fcuked up your car in the first place.

In writing? "Not Written = Not Said". If they won't give you a written admission of fault and promise to repair and pay rental, then maybe consider getting your car back now and pursuing it through an insurance claim.

Think of this - what if they get into the repairs and find more hidden damage? What is their incentive to do a 100% repair? An independant shop will do a full repair.

I suggest you get advice from a your insurance before you authorize work - they can tell you what your rights are in terms of demanding independent repairs etc.

Don't look at this as a shop incident - with that level of damage it's an accident pure and simple. Depending on your policy your insurance may choose to get the car fixed then demand payment from the shop. At least then you know the car is getting fixed.

Bent Frame!!! wow the guy must of floored it into the wall. I worked in a Valvoline quick lube (surprisingly well trained employees and well maintained shop). But we have had a couple of people drive into the pit (underpart of garage), and we do not fix their cars. 1.) they were NOT following the guide into the garage. and 2.) its on private property (franchised). Just be careful, They might try and pull a fast one on you.

Sorry to hear that. Whenever I take my car to a shop for an oil change, I try to be visible. If it's nice outside, I go outside and watch 'em. If cold, I keep an eye out while trying to stay warm. It's been an issue of mine with dealerships especially, as they take the car "somewhere" and you have NO idea what they're doing. As long as you have a written statement from the shop saying that they will take care of it, all you should have to do is find out WHERE they intend to take the car. Find out about the company and IF it doesn't meet your standards, demand that the car be taken to a service center of your choice (or just demand that up front).

Holy crap!, that sucks. The airbags probably went off too I'm sure. It might be totalled considering all the damage. You have the right to get it fixed where YOU want to, not them. I would think calling your insurance agent and discussingg your rights would be good too.

ok just came back from police station.
i was told if that shop which damaged my car dont fix it or pay me money for damage, then caps will go there to make a report with that mechanic who was operating my car.

Good! You def did the right thing going to the police station...now just call your insurance company, settle where you want to get the car fixed, and I believe that if you have comprehensive, they will pay and then go after the garage's insurance company.

Please make a police report and report this to your insurance agent (if you have insurance)

Do not trust them even though they seem friendly.
(They're trying to save money)

I suggest you talk to your insurance company and DEFINETLY get a police report to sue them if they refuse to pay for the damage at the shop of your choice.

A bent frame is not minor damage.

Your best bet is to contact your insurance company and let them handle the entire matter. They are experts in handling these cases. You are a layman and have nothing to gain and everything to lose by talking to the people who damaged your car.
Why do you think you pay your insurance company a yearly premium? Let them earn their money.

it could have fallen off of the lift. i know working in a garage sometimes the rack isn't set right or one of the arms fail and a car falls.. that sucks.. the whole shop runs over and starts laughing at you cause you effed up.. >_> not that I'VE ever done that... haha

have your insurance come out and take a look and give you an estimate.

hitting the wall, unless they were driving pretty fast wouldn't have bent the frame. i'm thinking they dropped it off the lift. and if thats the case there is probably more damage done to it.

i work at a dealership, so whenever we wreck a car here they try to calm down the customer first and then fix the bare minimum to get it on the road and make you happy..

yeah i think it probably fell of the lift. Unless they hit the wall at 25MPH + i cant see how frame damage involved, and any mechanic pulling a car into the bay at 20mph should be fired. Ive seen a car fall of a lift, it is a scary thing to watch.

One of hte apprentice techs at my work, had an 05 malllfinder on the lift doing some warrenty work (something suspension related) he was pulling on the extension bar, and the car slipped off the hoist, i swear to god every part of the mall finder was damaged.
