My poor maxima.....
My poor maxima.....
So today started off as a great day for my max.. went to the junkyard to find a new fender splash guard, then headed to the hardware store to get a 3.25 inch hole saw to install my prcai.. and then I open my door and get nailed by some idiot woman parking next to me. She had the nerve to claim we were "both at fault, for neither was paying attention". Newsflash: YOU HIT A PARKED CAR, MORON. I took many pictures, that show she crossed the yellow line into my space. I was parked perfectly. My door is crumpled pretty bad and my hinges are toast, im not sure if the fender is gonna line up either. I'll try to post pics later... Got nothing else to do now that I can't go anywhere
dude, that sucks...always ends up that way, huh? try to do something good for the ole girl, then something ELSE happens to her. I myself am just about saved up to replace my entire exhaust and was planning on doing it next week. But I went to go p/u my gf from work the other day, pass through a construction zone, rock flies up and hits my windshield and CRACK! Now I got to spend $200 to replace the windshield instead of using that money to replace the exhaust. Sheesh
glad to hear you were ok...just be happy that you weren't stepping out of the car while wild woman decided to go side-swapping cars. pics FT(insurance)W

And natty... haha I was stepping out. If I didn't hear her hit the front of the door, I would have probably been pinned in between the door and the car. The car moved a foot forward, luckily it was in neutral. But yeah,
that sucks about the windshield... Doesn't insurance cover one for free?
PICS:

You can see her tire mark in pic 2. She skidded after she hit my door.. she was on my side of the line.

What part of Boston were you in? This really sucks and it is not your fault. Did you file a report w/ the police? If you haven't already do so, as it is not your fault when YOU get hit.
I have a witness. I don't need a police report, it was 100% obviously her fault and that is undisputable. Insurance company can't even try to screw me when I have a witness and pictures showing that she hit a parked car.
Even if you dont "report" it to your insurance, its good to have a police report to fall back on if the other individual skips out on you. What if she sais shes not paying for all of the damage when the estimate comes out to be alot more than she thought ?? You even already said she wanted to split it 50/50....
No, I never said that. We didn't discuss insurance. She claims that it was half my fault that I opened my door, when in reality she crossed over into my space at her own fault. This was also right when she hit me, I'm pretty sure she was panicing. She proceeded into the store as I took her info from her reg, and one of the people I was with told me she was talking to an employee inside the store and told them it was my fault. They all laughed at her after she walked away. This was quite the scene, probably 12 people crowded around me.
My insurance company reported it as her fault by default because my vehicle was parked. Yes, I know the report is good to have but we both had places to be. I have detailed pictures and like I said, I have one official witness and 5 more available if necessary,NOT TO MENTION it is not her decision to pay for it or not. Her insurance company pays for the damage, and then she will get a surcharge on her insurance. I can't believe some people, though. What if I was standing there next to my car rather than just stepping out? She must be completely dense or have tunnel vision, which is scary either way. I hate idiot drivers!!

I remember one day last summer, I was driving down a side road in my city and TWICE, two drivers opened their door right before I was about to pass their car on the side of the road. Both times I was lucky enough to swerve and miss their door. One of the times the stupid biotch jumped out of her car with the door and I missed it and her by like half a foot.
I dont wanna thread crap this but I just remembered after reading swats post, if you open your door and someone else hits it, you have to pay to get it fixed and the other person gets a ticket. Might be the other way around. Please dont quote me. I dunno if that goes for "in a parking lot" though. Because it seems like ur door was opened way before she hit you as to opening your door while she was driving by the spot. But in your case it is a little different. You have proof of pics and a witness so you are looking good at this point.
Welcome to massachusetts is right.. Some seriously bad drivers. No, I can not see how that rule would apply here, my door was open and my foot was out, I was talking to my buddy in the passenger seat and facing him as i was stepping out, and CRUNCH. There goes my door. Even if the door was shut, I'm pretty sure she would have taken out my mirror/fender. The pictures are pretty conclusive, at least I hope so. On monday I'm taking her to some place that will give me a quote, and then getting a quote at a shop, though I may end up doing this myself.
THE PLUS SIDE: I'm not sure if its visible in the pics, but theres this weird crease type dent on that door, inflicted by the previous owners wife. It's been bugging me for some time, and finally it's going to be fixed! My car is out in the driveway, with its interior light fuse removed (the door won't hit the switch). I did notice something else.. Where the hinges attach to the body of the car appears to be warped, I'm hoping new hinges and door will line up properly if I replace them. If not.. to the body shop.

at least the insurance company sounds like they are going to cover it. Up here in Canada, parking lot "collisions" are 50/50 by the parties involved bacause they occur on private property.
wow...your pictures clearly show that if she were to attempt a normal park, then you would have enough room to open your door without her hitting your car.
thatz some pretty f**ked up sh*t man but goodluck with your case
