What can I do?

Ok ... as it goes like this. My friend and I were getting ready to go to lunch, so I decided to drive. I have my drivers side HL out fitting my A6 projector in, and this will come in to play in a moment. As I am backing out of my driveway, this truck that lives 4 or 5 houses down comes roaring down the street. I live on a corner of a somewhat busy street, but worse yet, there are a ton of kids on street, including my g/fs 9 yr old daughter. The truck locks em up and slides 1/2 way into the "T" intersection sideways. My buddy and I just rolled our eyes thinking this chick ... yea, girl was hotrodding this early 80's Chevy p/u. Anyway, to make a longer story short, I end up in the left turn lane (single) 2 cars in back of this girl. Light turns, she goes, we all go, she dumps the gas, opens the 4 barrels and looses it. She ends up going accros the median strip into oncoming trafic. The first car in line swearves and missed her, the car in front of me locks up the brakes on the Lexus Rx300 (POS!), it was wet, I slid into her. Cops came, no tickets, he didn't care that the truck caused the as$ident, and the truck sped off as soon as the wreck happened. I think she knew she caused it.

I have a $500 deduct on my insur, so I am out that anyway, but is there anything I can do ???? I thought of small claims court, but ... here's the catch. Not being judgemental or rasicst, I have Hispanic friends. My block is all 3 BR, 1 Bath, 1 car garage homes ... there are 4 Hispanic fammilies living in that house, they all share the truck,and one of them cuts my lawn from time to time. I feel like I am in a bad spot here and it's taken EVERY bit of restraint to not go down there at 3 a.m. and do at least $500 worth of damage to that truck. I can't do it tho ... I wouldn't feel any better in the long run.

HELP .... Please! Anyone been in a jam like this before?

so she spun out in a left turn lane....and as you were turning her front end hit your front end?

im sorry its kind of hard to understand the situation.

LOL ... yes, I hit the Rx300, she stopped to avoid the truck as the girl was backing out of oncoming trafic, back into "our" lane. So, if the Rx would have kept going, she would have hit the Chevy. I was 2/3 of the way thru the intersection, tried to miss her, but I slid into her. When it rains around here, the streets are mostly concrete, so .. they get slick, and I have new tires.

there was too many mentions of female drivers...i knew the outcome was going to be bad...but i was unsure of the final outcome.

I would go to the house and tell her that she needs to pay the $500 or your taking HER to court.

for what? i bet shes not even mentioned in the police report and they have no evidence (witnesses) im sure. sounds like a case thats a big waste of time. id say beat her husband/boyfriends face in

Ok. Why didn't you tell the cop that the accident was caused by another motorist and that you knew who is waas and could id them with the other driver? That would have made so much more sense. Your story is kinda unbelieveable. How far away from the truck were you that she ran into oncoming traffic and had time to back out and then the Lexus hit the brakes and you ran into them. It would make sense that you would have slowed down when you saw this truck go into oncoming traffic anf then back out of it. I don't by your story.
I think you just ran into the Lexus. Don't pin it on the Hispanics dude. And don't be a snitch because you hit another car. So what they have 4 families there. It didn't seem to matter before the accident so why should it matter now.

In the end you weren't following at a safe distance from the RX300. No matter the reason for them to slam on the brakes, you should be alert and able to stop in time.

But I feel for ya.

Mikey ... I don't care if you "believe" my story or not. I mentioned that I am in NO way predjudice, so how does that come into play? My friend that was with me is my witness and so is the driver of the Rx300. I did tell the cops that the truck caused the accident, read my post. I guess if your not going to offer any "helpfull" advice, I appreciate that you don't give any at all.

Morpheus ... I know I should have been further behind, but as I mentioned, it was slick and had it not been raining, I would not have hit the Rx300. Obviously the cop didn't seem to think I was at fault, thus no ticket was issued. Accidents are unplanned events that can always be prevented, but in the end, they do happen.

It's a little bit late. You and the other motorist should have agreed that the truck caused the accident and you know where that driver lives when you filled out the accdeint report wit hthe cop. If they weren't performing an act of wreckless endangerment the accident could have been avoided. Evil triumphs when good people do/say nothing.

GTR2000 ... you are correct sir! I had to go down to the PD to fill out my own accident report, cop didn't even take one. The driver of the Rx300 agreed that it could have all been avoided. I have her contact info, so it may not be too late. I dunno ... I haven't contacted the neighbors or anything, I don't want to stir the pot if there is no stew. (iow, nothing I can do, why bother them about it) The cop didn't seem to care one bit about the accident at all. He didn't file a report, didn't take anyones info, didn't ask for IDs ... nothing. I explained this all to my insur company and the lady on the phone told me they would get my copy of the police report and make a ruling to see if there is anything that can be done on my behalf. I doubt it ... really really doubt it. Worth a try I guess ...

Bad thing is ... I can get the parts (unpainted) that I need, bumper cover and hood, for way under my $500 deduct. So, I won't file it on my car, but the Rx300 got a scratched bumper, so I am certain that she will file it on my insur. Oh well .... I guess crap happens, but it must happen for a reason.

It's just like Morpheus said bro, you were following the Lexus too close and when you hit the brakes you collided with it. Why wouldn't the officer do an accident report? There was an accident right? I only brought up the Mexican thing because that's what you said. You could have said those people or just some girl from up the street. You said that they were Mexican. Does it really matter if the chick that was driving the truck was Mexican? Not really.
You asked what should you do. You should own up to following too close. The chick in the truck didn't cause the accident. You did.

Mexican? who said anything about a Mexican? Anywho. I don't understand why an accident report wasnt filled out. Kinda strange on the officers part. But if you feel as if something should be said, walk down the street and speak to her about it. Even though you're too late.

I don't have any choice but to realize that I was a bit too close, but I did not cause the accident, quite on the contrary really. But ... you have your opinion and that is good, thanks. Had the truck not been driving carelessly, there would be no accident. It is her fault that she spun the truck, not mine. Also her fault that the Lexus had to stop suddenly, due to her blocking the lane and also backing off the median strip. I didn't nail the throtle on her truck, she did.

The cops here don't fill out a report for $%&#, unless it's a fatal accident or an insurance person is there. They are told not to, takes too much time. Whateva! I filed one with them on my own, but I seriously doubt it'll do any good. Even tho it is my neighbor, I know who was driving, and had witnessed her driving crazy before the accident happened. I am going to talk to the lady driving the Rx300 and see if she filed a report or if she will give me a sworn affidavid as to what happened. My friend also gave his view on the reprot I filled out.

Such BS that someone causes an accident, then speeds away and there is not a damn thing I can do.

In any motor vehicle accident the arriving police officer must take contact information from the parties involved. Did you take his badge number and case id number?

Go to the cop station that he works at and speak to his super intendant. File a police report claiming the truck being at the scene of the accident and the fact that it caused it and left the scene, which is also illegal.

This way you dont have to have direct contact with your neighbors.

Or, go over there and politely find out who drove the truck that day at that time, and ask them to pay for the damage or else threaten to file a police report.

I assume you ask because you care for your money. Thus why shall someone escape the law and get away with reckless driving? there are no bad feelings involved, just being fair. At least thats what i know of going on here where i live...

next time you see the young lady flying down your streets you stop her and ask her to freakin relax or she'll have a visit from an officer. as for the accident, no ideas here. its a tough one.

I did get his badge # so I will be talking to his Lt in the a.m. ... I work nights.

I don't want to have any ill feelings towards my neighbors, he11 they cut my grass now and then. It's not like I dislike them by any means. The ONLY reason I bring up the fact that there are 4 famz in the house is I don't know if they are here legally or not. It really doesn't matter to me, they are not (usually) causing anyone any probs, so ... I don't feel the need or desire to cause them any either. IMHO, that may be why she sped off so quick. Thing of it is ... I don't know (and won't unless I ask I suppose) if they would have the money to fix my car, not to mention that it will still go against me on my insur.

Like I said, I am not trying to be a ***** bag here, but you're right ... why should someone get away with causing an accident and not have ANY recourse taken? Not fair, and I realize in my 32 years of life that life is NOT fair ... I have pretty much gotten over that part anyway.

Yo, that kinda sounds a little racist man. All you can do is go up there and explain the situation to the chick that was driving the truck. Then ask here to pay for the damages. Then you will know if they have the money or not. I totally agree with the fact that if she caused the accident, that she should be liable. The officer really should have taken a report at the scene.

I mentioned that I am in NO WAY trying to be racist, and that I have Hispanic friends. is your problem with me? You make this seem like I am out to get my neighbor, who happens to be Hispanic. I'm not so get over it.

Only reason I even mentioned that they were Hispanic is because I don't know if they are here legally or not. I grew up in Chicago where 4 fammilies in 1 house was common, but they were not ever leagaly here. I am not making assumptions, just stating a fact. I don't know of any Hispanics that are here legaly with more than one family in a home. I could be corrected here and I am open to that, but that is not the point anyway. I know that they share the truck, I know what kind of shape the house they rent is in, what kind of clothes the kids wear ... etc. By knowing these things, I understand they don't have much money, this is why I let a couple of the guys cut my lawn from time to time .. trying to help neighbors out.

Anderi mentioned about going to talk to them, and I may do that still. I just don't want to cause problems with my neighbors if they choose to take it the wrong way and be defensive. I have to live 4 houses down from them, I own my home and I am not moving anytime soon, therefor I would like to keep the peace as much as possible.

Americans drive different than Mexicans, especially if they are here illegally. They already broke the law if they crossed the border illegally, and the behavior that follows is not necessairly law abiding. That's in any state, and it is all too common. I have nothing against mexicans but bottom line is some states once the cops find out they don't do anything cause there is not much they can do. Technically if anyone has damage over $500 by law a report is supposed to be filed. Seeing sanding a bumber and painting it can be over $300 plus the damage to the maxima, a report should have been filed. The insurance company doesn't really care once they find out you don't hve a report cause they just take the money.

The definition of "who caused the accident" varies, in your situation, from state to state. In most places, though, unless the Lexus had swerved to avoid the truck and hit you, the accident would be considered 'your fault' for following too closely. Not fair, but true.

What about an improper lane change on the Lexus's part ... my friend that was with me reminded me that she cut me off, I was in the clear untill she jerked in front of me.

I am gonna give the cop shop another day or two ... then call and see if there is any progress. I have a lawyer friend at work ... I'll ask him about this too. See what he says.

that's the best thing to do.

A long while ago I had a guy roll backwards into me at a red light - then he put it in reverse and hit me twice before he drive off. No witnesses. It was considered "my fault" because it was the front of my car and the rear of his.
