thats not as bad as what happened to my car... parked on the side of my girlfriends house.. i hear my alarm go off run outside... and i see another car smashed into my car... pushing it on to the curb... here are pics in my photobucket... and then pics of me repairing it at my shop... getting painted this week the insurance company totaled the car.. and gave me 8100 for it.. paying 4 grand to fix it since i work there should of been about 9 grand to fix. first 2 pics are just from me fixing it before the accident now dosnt that stink i start to fix it and this happens but ohh well now i get to get paid for working on my car http://s19.photobucket.com/albums/b1...team/MY%20CAR/

small claims GL unless you get a nice judge that got hit or got blocked at some point in time by some old lady and sides with you .

But the unfortunate part is that I'm going to bet your car is going to be totalled. the repair cost to fix that RQP is NOT cheap at all. you have to cut the body into pieces and re-weld the entire thing.

yea they gave me 8100 lucky i guess. all i have diff in it atm was a alarm and remote start..and 74000 miles.. leather was mint etc.. nothing was wrong wit it.. now ima see how it comes out after i spray it.. if it comes out good.. then ill keep it well see.

Hey man yeah...just do exactly what every one else is saying excpet burning her house down(yes i know its a joke)

If u have pictures, photos of height and of course some time and energy to put into this...u will get your money...same deal but in a parking lot happened to me in my 99 4th gen...i ended up with like 17-18 K from it, and my car back....medical bills (hahaha chiropractor) and the car was totalled but fixed...and i got 9900 for my car, and i bought back from the insurance company fixed and ready to go for 1100 bucks. i scored hard core but it took 6 months and all i did was take pictures and threaten to have my lawyer to get invvovled. I also had the same situation after all that happen were some one hit me in the parking lot..and i had to prove that it was her...she had no license..so i took pics and got all the mesurements...told the cops and i was on my way...just takes time..but go find a cool cop(thats an oxy moron) and and make a report...tell him ur circumstances..and all that has happened...the cops if involved can get all her info and her insurance info...u call make a claim and let it go from there...

Sorry to say this but you wont really have a case in small claims court. This is what would happen:
Pay everything or I will sue you. I am not paying for everything. Court comes around she old me she would pay half which is admitting guilty. The lady says I said no such thing he said she said stuff. I might mention a lawsuit but if she presses unfortunately I would take half. Also, because of the creases in the metal that is out of the realm of paintless dent repair.

you probably would have had a case if you would have handled it correctly. good luck on getting payed 3 months after the fact with no police report/insurance claim/anything. like i said before, take your half and be happy (if that offer is even still on the table).

you cant deny that both her fender and the marks start at 28 inches. and she has horizontal lines on her fender, and that same pattern is embedded in your paint....wtf

but you can deny it was you. there are what, about 5,000,000 suburbans on the road and no paperwork to back up the date/location. then you have a 20 yr. old vs. a 50 yr.old which i would think would work against the op. i'm not sure how small claims court works (don't watch judge judy) but the phrase "reasonable doubt" pops into my head.

Im sure i could get a police report made... She was gone when the incident was discovered so there was no way to make the report if both Owners weren't present.

My buddy just got accepted to San fernando Police Department, im sure he can work something out. Its not like Im breaking the law...she DID do it. lol

"reasonable doubt" is for criminal trials. "more probable than not" is for civil. blackonblack98, I do agree with your analysis though--given the parties involved here, he'll probably need as much of this documented as is possible.
