No Visual Damage, no claim#? no ticket????

hi guys, i have a question to you guy. what happen if you get hit from the back, there is no VISUAL DAMAGE to both your car or the other party car,but your whole bumper is out of alignment. The cop came and said, "I'M NOT GOING TO GIVE YOU A CALM#, I DIDN'T SEE ANY VISULA DAMAGE." Of coz that guy DIDN'T even get a TICKET. IS this right? can i still get his insurace to pay for my damage? HOw come the cop didn't give me claim# and not even give him a ticket????

no, its not right...

its the incident, not the damage. He cannot make that assumtion. He can say you didnt hit, but can reasonably say what was damaged.

I would contact your insurance company and give them the officer's name and #. Let him explain his actions to the insurance company. It will be stuck on yours, but you may not have to be out of the full deductable.

I had the same thing happen to my Honda a few years back, except the guy that hit my car was a family friend of the cop. It was a chain of events issue resulting in a pole falling on my car, and the cop said that since his car didnt hit mine he decided not to fault the accident. I argued to no avail. So, what ended up happening is that my insurance sued the guy personally ($4000) and his insurance didnt want to pay because there was no ticket. They ended up garnishing his wages. So in the end, the cop really screwed his friend, not me.
