It is legal in a few states to exceed the speed limit while passing.
In particular, Washington state has the following statute:
Montana has a similar statute although I can't find a copy of it right now. I'm pretty sure a handful of other states do as well but I don't know for sure.
As a general rule though most states make no special provisions for speeding while passing. You can try to argue the "must pass safely" angle but I wouldn't rely on it.

Minimum speed regulation -- Passing a slow moving vehicle (1) No person shall drive a motor vehicle at such a slow speed as to impede the normal and reasonable movement of traffic except when reduced speed is necessary for safe operation or in compliance with the law: PROVIDED, that a person following a vehicle driving at less than the legal maximum speed and desiring to pass such vehicle may exceed the speedlimit, subject to the provisions of RCW 46.61.120 on highways having only one lane of traffic in each direction, at
only such a speed and for only such a distance as is necessary to complete the pass with a reasonable margin of safety.

wow, good find!
I'll print it and ask my mass cop friend what he makes of that. I'm guessing he's going to say there is a strict law that forbids speeding and that is just mumbo-jumbo and wouldn't hold in court, but I'll ask and we'll see.

The way I read that is the car can be operated faster than the posted speeds, depending on the actual zone, for a specific distance. It doesn't specifically address passing per se. It's all kinda of a technicality because the distances are so short it's almost impossible to pass without slamming on the brakes after to slow back down and the simple fact that if a cop wants to write you, he'll write you up regardless.

that's the way 99% of "people" driver here (North East USA).
It's like they don't give a $hit about anybody else. Sad, but true.
So whenever I get to drive in Canada - it's a holiday to me
