police officer scratched my car, what can I do?!?

police officer scratched my car, what can I do?!?

hmmmmm....I must be out of luck these couple days, first kids in their barbie jeeps scratched my bumper, now highway patrol officer scratch my side mirror with his flashlight.

anyways, here is the story
I was speeding and he pulled me over. gave me a ticket for driving 80 on a 65 freeway. then when he was about to leave, he accidentally knock my side mirror with his flash light and yes! he knocked it hard and the mirror folded back in. I didnt want to say anything because I just had enough. But, that's not the end, he came back to me and ask me why do I turn on my foglight and he wanted me to turn it off because there is no fog. "Ok, officer, I can turn it off" I replied. When I got home, I noticed that he left me a scratch on my mirror.


I dunno what did I do wrong recently

You need to call him on it ASAP. Then when the case comes up in court make sure that you bring that up. Don't be a jerk about it, but take pictures and make sure that it is documented. I would be interested to see if he would lie on the stand.

Maybe they even got it on their on-board camera, but you will probably never know.

i had an incident with a cop in charlotte the other night. he was in the median attempting to come out. i stopped to let him come out and he then decides that he is going to sit there. so i wait and he still has no lights on. i start rolling forward and he decides he wants to go. he guns it and puts his nose about two feet away from my passenger side door. i pull as far as i can to the right and scratch goes the front rim. he floors it and takes off. he stops at the light and just sits there. i wrote down his tag just in case. light goes green and the throws a u turn and fishtails. he hits the curb then punches it again. i swear it looked liked a kid who just got his license. i called and told them about it, the rim was not that bad but i wanted them to know in case the guy has a habit of being a horrible driver and endangering peoples life.

If you can afford it, get the damaged fixed and send a copy of the receipt along with a detailed letter to the police department requesting reimbursement. See if that will do it for you.

You can do this with trucks that damage your car on the freeway with rocks and stuff their huge tires shoot out at you when you're behind them. And you can do this when your tires/wheels get damaged from potholes on the street where you let the city know about it (I forget what general department, though).

Give it a shot. Can't hurt to try.

i told them not to worry about it since i wanted it to match the other scratch that sears put on when they did my tires.

if the cops in your area don't use tape, nothing. You can't prove he did it so why should they belive you? You didn't say anything when it happened so he might not even know he did it. Even though he hit it hard enough to move it, it happened with the end of a 2 foot flashlight so he might not have felt it.

and if he denies doing it, he might not be lying on the stand... and NEVER accuse him of lying even if you think he is. I did that once (cop on the stand and I said to the judge "what can I do if he's lying?" and the judge almost put me in jail for contempt).

you're probably just SOL ... fix it and move on.

A traffic court judge or magistrate has absolutely no authority to do anything about the cop having scratched your car. Mentioning that in court will only make you look like you're reaching for an excuse.

What you need to do is call the headquarters and file a report with a supervisor. Tell him you want it documented and investigated, and if he refuses, get his supervisor's name and do the same thing with him. Remember--it's not worth it for the cop to lie about it because if he's caught lying, he's out of a job.

thx all....I dun plan to do anything about it, not even fix it. just go to the court, get my approval for traffic school, pay the ticket....and hope my insurnace rate will not go up. I dunno if I should go to traffic school, since I got my last ticket was 2 years ago and this one will just add 1 pt onto my DMV record. I wonder if my insurance company will increase my rate just because of 1pt on my record.

I never challenged a ticket....esp. speeding, all the officer has to say is that his radar detected that I was going above speed limit. I am sure the judge will believe him.

oh well....just another bad day and it's time for me to move on

last weekend has been bad for me too.. i got a ticket for 85 on a 70 area. and when i got home to rotate my tires my bolt came off.. and im breaking in a camry for my parents...

You're all missing the obvious. If he scratched your mirror with his flashlight, call him out on it. I guarantee he has the same Maxima paint scuffed mag light hanging from his belt.

If he gets a new light, there will be a record of it.

Isn't carguyrob an officer? He shold be able to back this up.

Btw, MaxSEAE, this is not a flame, but not all cops are ****s. AAMOF, most are very reasonable people.

I think if you tried doing their job for a week, you might understand their occassional sour disposition.

if he got you on radar, he has to show proof the detector was calibrated recently. Belive it or not, there are alot of loopholes you can find your way out of. Ive been in almost every single courthouse in all of SF Bay Area. ive never had 1 ticket stay on my record cause i always win my cases. (knock on wood) anyways, if you need some info juss gimme a call...lata

Your entitled to your opinion, but I think thats sort of a broad statement. They aren't all ****s, infact most aren't. It's that small percentage that ruins it for all of them.

unless you can get CSI in to do some atomic-level analysis, it's paint on a flashlight. Since he didn't say anything at the scene there is no way he'd win this one, but if he tries I hope he updates us on the outcome.

You have missed the point

Call and leave a message for the officer to call you, be polite. Once you have a chance to speak with him explain what had happened. I doubt he will want to go threw the paper work to get your car fixed, so hopefully he will throw out your ticket. My Brother in law is a police officer and he has made calls for me to other ones, even out of state to get tickets ripped up. Most cops are into their cars, he will probably understand.

thx all....prob I wont bother with the sratch since it is not significant. I know he had other things that he could bust me with....like my headlights/foglights/sidmarker/no front license plate/lowered/etc etc.

BTW, my hamster died the same night!!!!! <Sigh> she's so young...only 6 months old.

alright, Matthel...I think I need some opinions on this one. I think my ticket will be somewhere near 200 dolla and traffic school will be another 25. but if there is anyway that I can avoid all these charge....I would do it.
