Need some help - (accident related)
kind of new at posting, but i've been here for over a year, i mainly juz come here to read, but i'm in some mess so i was hoping for some advice.
about 2 weeks ago, i got into an accident, a car switching lanes hit the side of my front bumper and that got damaged, no damage to her car. well the other driver finally stopped and immideately claimed fault. we called about 3 times so that someone can come and make a police report. Waited about 2 hrs but no one still came. She was willing to give $400 to cover damages, which we both thought would be more than enough, but I declined, and said that I would get an estimate first. Got her information and everything, even a copy of her insurance, and went our ways.
well got the estimate, came out to about $1500... contacted her, and she thought that was too much and said she might just have to do it through her insurance company, but asked to get a 2nd estimate since that seemed high. Well got a second estimate, nearly the same amount, about $50 less...
tried to contact her for a week after that, no response... finally after a week of calling, her husband answers (really ****ed) and told me not f**kin call anymore and that I either contact an attorney or the cops.
I'm thinking I should call the insurance agent or make a police report so that something can be done... but I have a feeling I'll be getting screwed either way.

First step is for your sister to call her own insurance company to let them know what happened, if she hasn't already. Update them on the latest details. The insurance agent/adjuster should handle filing the notice with the other parties insurance company. I would bet they did not even file a claim or notify their insurance. Even if your sister has to pay her deductible up front, when her insurance gets paid back from the other party, your sister will then get her deductible back. Much easier this way, and puts the burden of collecting on her insurance. It's part of what they get paid to do.

We did consider filing a claim on ourselves, it's a $500 deductible... but with no police report and real "proof"... i doubt i would ever see that money again? Plus it would raise our premium for sure, considering she's a minor, 2nd accident, first wasn't her fault but that was taken care of perfectly, another option would be to just repair it ourselves...

i think your best bet would to be to pay for it yourself. if you call the cops then you get a ticket for leaving the scene of an accident. if you call the insurance company then they will give you the money but will claim it as and at fault accident with a payout larger then 1500. so now your rates will increase and you end up paying for the accident anyway and plus some. so i would say pay for it out of pocket and lesson learned. next time just wait for the cops no matter how long it takes.
