GoT puLLed Over today

got pulled over for not fully stoping at a stop sign. she said i didnt stop at all... but i know i stoped. she also gave a ticket for tinted front side windows, and not wearing my seatbelt. and i just got my license back like 2 days ago for a speedin ticket... what cna i do to avoid paying for this? plz no sarcasim im serious.

You can try to fight the stop in court; the rest is really your word against hers (well, minus the tint if that's illegal where you are).

Were you actually wearing your seat belt?

Good luck, I know of someone who got followed to his house once and the cop actually parked in his driveway to issue the ticket... I heard THAT was illegal up here, but who knows...

PS. Shoulda stuck $5 out the window and asked for a fi dolla saki saki!

If it's any consolation, a secretary in my office got pulled over last night by a female officer. 15 over and got a warning. Then, when asked if she was wearing contacts, she answered no and promptly got a ticket for not wearing her prescription glasses. She's been going around the office asking your very same question...

First, you should have been wearing your seatbelt (but you probably already know that) second, is any tint on the front windows illegal where you are? if any tint is illegal then you're in trouble, if not then drop your tint and have an inspection place "certify" that your windows meet legal specifications (since i'm sure the officer didn't test your windows) that should get you off for the tint. But in many states only the moving violations count towards your points (the not stopping would be a moving violation) the others (tint and belt) may not count towards "points" or insurance.

Where do you live? The tinted window thing you can fight, the cop is supposed to measure your tint with this tool, and you can fight them if they didn't do that. You can tell the judge you were pulled over into a shady spot. That ticket is bull if ie ver heard it. Don't listen to them on that, I have a background in law.

i was wearing my seatbelt... but i took it off before she came out because i was looking for my drivers license in my pocket, and im positive that i stoped... i dont know why she said i didnt.... and she was hispanic and looked really really mean....

Dude, I had the almost exact same case a few months back in NY. I got a "slide" ticket for sliding through a stop sign. After I got stopped I removed my seatbelt to find my license and got a ticket for not wearing it at all. In court, I argued that I did fully stop and there is no way someone can fully observed that I did not come to a full stop unless they were directly behind me. I admit I can be pretty convincing since I got a BS in pre-law. Next, the seatbelt thing I told them it was just released after coming to a complete stop to prepare my license and registration. I didnt think there was any harm there. In any event, I won both cases. Oh yeah, it did help a lot the cop didnt remember almost anything about that stop. Traffic court dates are usually 3-4 months away in NY. My thoughts, do as I did... DENY .. DENY.. DENY... and stick to it.

His driving record speaks against him so I would not try to fight it. What is he going to say: "Judge, I just got back my license 2 days before and I was really paying attention to make sure I keep it this time"? The way I see it, if allowed it's better to take a defensive driving course for the moving violation. The other two tickets are no big deal whether he wins or not.

YOUR RIGHT! only problem is they will end up costing u more the the original price of the ticket. unless u have a friend or some1 in the family whos a lawer then there isnt much u can do.

well im going to argue everything because i couldve sworn i fully stopped. thats why i was so confused when she came up to me. and i was wearing me seatbelt, and im going to give them a picture of my car with out the tint. so hopefully ill get out of this crap. wish me luck guys and thanks for the replys. anyways my dad is a lawyer... ill talk to him about it when i get my court date.

Any mistakes on your ticket?

Sorry to get off your topic...

On my way to the dealer (3 weeks ago) to pick up my new SE, I was also stopped for rolling through a stop sign which I was positive I didn't do. I think the cops just need to meet a quota. But I found 3 mistakes on my ticket... my address was where it says IDNO, my IDNO as my city, he wrote my address twice, and said my birthday was __/__/03. Do I have a chance of fighting this?

officer needs to make a "good faith effort" to identify you. If your name is there, it's you.

incorrect information is one thing, correct info in the wrong place is probably not going to help.

There may be a way to get out of all the tickets. The officer would have to be able to testify that she could see the stop sign and your car. If she was in some position that would make it impossible for her to see the stop sign, then you can argue your case. Otherwise, you'd probably lose, even with a lawyer. Most judges or magistrates look at it this way (and so do I). If a police officer intentionally lies about a violation, he or she is subject to losing his or her job and possibly going to jail. Why would it be worth it to risk all that just to write you (somebody they don't know from Adam) a ticket? That is why judges usually believe the cops over the defendants.

How about incorrect info in the wrong place. For example, part of my address repeated twice and my birthdate being born in 03. Doesn't that say something about his judgment?!

It's already too late to apply my advice if you just got your license back. But, from the word go, never ever just pay a ticket. Go to court even if you have absolutely no shot of beating it. Tell them you don't care about the fine but you don't want the ticket on your record, if you have a clean record they will almost always give you an option. In my case I have 3 times now paid court costs in the exact amount of the potential fine and gotten a suspended sentence that went away if I stayed clean for 6 months.

That definitely says a lot about the cop. When you go to fight the ticket, talk about how you were positive you stopped at the sign, that you unbuckled your seatbelt to get the registration etc etc. Then bring up the fact that the police officer was not accurate in writing out the ticket, which speaks to her attention to detail (lack thereof) and unprofessionalism. I know friends who got off tickets because of technicalities such as wrong info on the ticket.

My method Works

If you look on your ticket it shows when the court date is if you decide to take that route. Well the reason she put that date on there was because that's the day she is free and can attend court for all her tickets.

Here's what you have to do...Change your court date to the next day or some other day by making some excuse like you have a test or you have to work that day. By doing this, the chances of the cop showing up on a day that isn't marked on the ticket is unlikely. If the cop does not show up the ticket is thrown out. This is advice from my lawyer friends. Hope it helps.

You're supposed to sit patiently in your car with your hands on the wheel and your belt on until the officer gets to your window. When he or she asks for your license and registration you then go looking for them, not before. For all the cop knows you're rummaging around for your handgun and not your license...makes thier lives alot less tense when they're walking up the side of your car if they don't see you scrambling around.

Max,
Write them a formal letter with an excuse, but do this when you receive the notice in the email with the court date. I would suggest even trying to postpone multiple times if possible.

Also, I don't know how it works in your state, but in MA the cop is not obligated to show up at the first hearing (in front of the clerk magistrate, not judge). In that case, there's one cop representing all of the cops, and they just read the report that the issuing cop wrote. If you get convicted in this hearing, you can schedule another one, where you go in front of the judge. In THAT hearing if the cop does not show up, you're free to go home with no ticket!

Find out how your state works, and then calculate your strategy accordingly. Best of luck!!!

IT DOES MATTER!!!!!!!
If a cop cannot fill out a ticket properly how can he be justified beyond a reasonable doubt that you were guilty of the stop sign violation. FIGHT IT.
Last resort for you would be a charity donation in court!!!
Don't plead guilty!!
Go to court and try to fight the ticket (be nice to the judge, ect...)
Remember to use the words Yes Your HONOR

If the wrong info on the ticket doesn't work try to plead for not guilty in exchange for a charity donation of courts choice.

i dont think there is a court date on any of the tickets.. there is an envelope.. i think i have to mail it in with in 7 days and then they mail me a court date. She told me about her court key or date... but i wasnt listeing to her stupid ***. she looked like a rookie... so im pretty sure she'll show up. this happend in Chicago, IL.

Don't sweat it! If she shows up, then plead your case. If you're still found guilty, go for another hearing in front of the judge. If she's a rookie, it's to your advantage. I would call the precinct and find out how long she's been on the job, and if she's new like you think, I would make a stronger case in front of the clerk/judge that she's not experienced enough, and may have made mistakes in observing your driving. Just stick to your story and sound convincing/confident.

I have gone through this process in MA. I had a NH license at the time and I fought the ticket on a technicality. The trooper put down my NH license number but for the state, he put MA. The magistrate said that did not matter. I appealed to get my case in front of the judge and the cop never showed. But the judge called my case and saw that the cop was not here. He said that he would come back to me to wait for the cop to show up. He never did. Judge said it was my lucky day. It was a $250.00 ticket. That was about 10 years ago when the speed limit was still 55 MPH on I-495. I was clocked going 85 MPH.

Bottom line. Always take the time to fight any violation. You never know, it just might pay off.

Quit driving like a thug. Wear your seatbelt. Stop at stop signs (full stop, no cali stops). And ditch the ghetto tint and none of this would have ever happened. No sarcasm.
