Question about Modifying!!

I see most but not all of you guys changing the muffler on the 2k and 2k1 maxis's an I wonder will any of you experience any trouble with emission testing, now that some states are tightening restrictions.
I was also wondering, since nissan makes a big deal about that muffler being one of the major reasons why the 2k and 2k1 have 222hp or a 32hp jump from to 4th gen. If some of you are replacing the muffler with this aftermarket mufflers but also freeing up a few more horses in other mods, then is the 2k motor just a different design engine but in reality the same one that's in the 4th gen??.
I'm trying figure out if the only big change for an increase of 32hp is just the muffler or a combo of other varibles.

Even with all my mods I still pass emissions

Whether or not you will free up more power with an aftermarket exhaust, I don't really know.
