Guys I got scammed Need Help

Hey guys. Ok. I found some rims on Ebay and purchased them but outside ebay cause there was a problem with the auction. People visiting the page couldnt use the buy it now deal. Well So I contacted him through the ebay email, and then proceded to send him money through paypal. Well, I havent recieved anything from him. He had good ratings before I did anything... But within the last week i find out he has done this to 4 other people. Well I sent a buyers complaint to paypal, and they did an investigation, and they said his account is empty and they cant do anything else. I really need to know what to do from here. Will I ever see my money again. He did email me saying that he will pay me back, but still havent got a refund. Any help would be greatly appreciated. I had to get new tires cause one of mine got tore up from pot hole. So I could afford to go ahead and spend 200 more and get 4 new rims and tires. from the cost of replacing the bad rim. Now I am out of money and being a college student, I dont know if I am gonna make it now with the loss of that in my budget

Sorry to hear that - That sucks!!!

Did you see his feedback prior to that. It definitely show his negative transactions. But it's not what you should have done, it's what you can do.

Unfortunately, because you didn't go through ebay you aren't protected by them.

You said you used paypal - did you use credit card? If yes, contact the credit card company, some of them have protection policies. I would also contact the District Attorney's office, they usually have a fraud division (I did this for a laptop that was a scam). Paypal should know this person's checking account, and if there is an authority involved they will be able to get the scammer's info, or actually you should be able to get it. If you get the person's info, that would be a good start.

I will tell you, with my scam, I never got my money returned.

Yeah I checked his feedback. He showed good rating when I was buying the tires... but the new negatives showed up after i had given him the money.

paypal and credit cards... Most cards consider that to be a cash transaction. Hence there is no protection when using a CC with paypal.

I would do this too. If you can get the credit card company to do an investigation on this in that you never received the goods, then you might be in luck. However, like Tim said, if Paypal and CCs go hand-in-hand as a Cash transaction, then you may be SOL. But at this rate, it doesn't hurt to try and the money is replaceable. You'll make it through this obstacle despite this setback, so keep your head up and investigate all your options.

I think eBay now owns Paypal...so they are one and the same. Problem with both websites is that they bury the customer service phone somewhere on their site. i used to have it when a friend of mine requested it.

options at this point:
1. like a post earlier, if you paid by credit card, you should be able to dispute that claim.
2. contact paypal again and ask how you can take legal action against another ebayer. it's written somewhere in the agreement that they should disclose that information...i believe. Hey...doing business on ebay is not like starting a corporation in Nevada. You can't dodge/hide from the laws.
3. take legal action against paypal/ebay (it's a shot...like a dog chasing its tail)
4. here's a good tip...call up a lawyer and ask over the phone if they have ever done a case involving eBay auctions.

BE SURE TO DOCUMENT EVERYTHING...TIME/PLACE/WHAT HAPPENED...in other words, keep an ongoing journel. Print out the auction item page. Print the paypal receipt. print the confirmation emails.

I dunno if this helps.

this is bull.....if you have excellent credit standing with the cardholding company, they will refund you no prob.

my credit is excellent and if I ever have problems with vendors, I use my recourse as a cardholder...this is why I ALWAYS make it my business to pay for EVERYTHING with credit card...always recourse if the item doesnt work, damaged, whatever and the company refuses to refund the $$

they "may" refund you no prob... not "will"

my wife works at a CC processing company and her job is to settle disputes among buyers, vendors, and the CC company. CC companies have an agreement that they'll try to help out with Paypal disputes. They DO NOT have to do this, and if your charge is too much the will not help. Paypal is cash. When you put your CC number in, you just put cash in an envelope and sent it. There are a few safeguards in Paypal but if the person closes their accounts or has no money in them, ultimately you're screwed.

Obviously you know now you shouldn't have gone outside ebay to do buy this but it's worth saying again... if a seller tries to get you to send money "outside" ebay, you're probably being lined up for a scam.

From what I've seen, and my friends have excellent credit and had their accouts for 10+ years, if the dispute is more than about $200, your CC company is not likely to help much. Technically since there was no fraud in their side of the tranaction (you -> paypal -> cash to seller), they are not obligated to help just because your package never showed up. They are only obligated if paypal never transfers the funds as you've instructed or they erroneously draft your account. You are only fully protected if your transaction is conducted directly with a company with a merchant account. In this case, youre doing a third party transaction.

I've heard BA, Citibank and Discover covering small loses, but refusing large ones. But it never hurts to ask.

Man, I'm sorry Fezzik. You were getting close to an AE max as well.

Anyways, there is a member here on the ORG who works for eBay. I can't remember his name, and it doesn't come up when I try various searches, but I'm sure someone else here will remember. Maybe he can help you out and point you in the right direction with regards to having action taken or getting your money back.

Well i got something back from the person and this is what he had to say:

no im sorry guy im not blowing you off or anything like that actually the fbi is already involved with me and im trying to refund everyones money asap but its hard to get as i dont have it right now i can deff refund your money for you next thurs if i told you any earlier than that it would be a lie. if this is ok let me know

So, who knows...

do you have his name, address, phone, etc? Maybe the fbi really is involved and he's scared. You should get as much info out of him as you can in case you need it later.

Ok, you can tell him you are willing to work with him. You only intention is to get your money back. You dont want to have to take any further, however, he must reassured you. Inform him the only way to do that is make contact with him. Get his full name and phone number, ask for his address and any other identifying information. You can also remind him this information can be made available from last paypal account, however, if you must go thru those steps you will file formal complaint with the authorities.
On a side note: Citibank actually surprised me by reversing a $1900 charge on my c/c. I had good reasons though but it was fully authorized and legit charge. I did count my blessings.

Your credit card company should refund you ... some gal set up about 10 auctions on eBay .. she had a zero rating ... 9 of the 10 paid her via PayPal (I refrained b/c I didn't get a warm & fuzzy feeling). She proved to be a scam ... the RCMP are involved and most of the people had the money refunded by the credit card company .. I think that the fact that so many people complained added credo to the fact that this guy was a scammer.

You may want to wait a couple more days b/c he did say he's trying ... however .. he did scam you guys ... so he should get put over the barrel .. my 2 cents.

Actually I got scammed with PayPal once and Citibank was more than just a bit helpful. Someone hacked into my PayPal account and sent money to someone. I had my PayPal account locked and then called Citibank, they treated it like a theft. I was very satisfied with them.

Citibank is one of the tougher companies against fraud. If you're a retailer, Citibank is not a bank you want to deal with. imo
