Deer Suck!

So,

I'm heading to work tonight come around a turn and theres a deer standing in the middle of my lane, I swerve to miss it, (I'm guessing I hit gravel) start to fishtail across two lanes of traffic (luckily no other cars) slide back across and spin around two times before smashing into a telephone pole snapping it off at the base, coming to rest about 10 feet away from about a 5 foot drop off into a persons backyard. The left front of the car (passenger) is all f***ed up. Its about a foot shorter on that side than the driver side. Both airbags delpoyed and the odd thing, the passenger side window went down ( ).

I'm not really sure if I'm hurt or not, I have some brusing from the seatbelt, but I'm not sure what else is wrong yet, I'm waiting until tomorrow to see how I feel.

My car as of now is f***ed, I have to wait until I hear from my insurance company to see if they're going to total it or not. To be perfectly honest with you, I hope they do. As much as I love/loved that car I don't want to ever ride/drive in it ever again. I don't want another 5th Gen, possibly a 6th Gen.

But, maybe I need to switch car companies all together. It seems that I've had some bad luck with the two Nissans that I've had. Its odd but I've been thinking about it tonight, and since I got my first Maxima I've had a lot of crap happen to me, and now with my second Max, well...see above.

So, now its nothing but a waiting game. I'm going to go and look at the car in morning, and go abck to the crash site as well, to see how damn lucky I truly was. I'll keep you guys updated, and I'll try to get some pics.

Oh, and btw, the best part about all this bullsh*t, today is my birthday.

sorry to hear about your misfortunes, but I fail to understand how the car company was to blame for this unfortunate accident?

Glad to see you came out of relatively unharmed.

You were probably better off hitting the deer. How fast were you going? What was the speed limit? What were the road conditions?

I fail to see how the deer is at fault.

Sorry about the wreck as well. If the Deer had not been there, he would not have had to take avoidance countermeasures. I always have the possibility of hitting Deer on my daily drive to/from work. That's why I'm always on the lookout for them.

IMO, the municipality in which this happened is at fault as they failed to control the deer population. I live in Central NJ also and the deer problem is nearly epidemic; a doe almost broadsided my Maxima about 2 weeks ago in Hillsborough Twp. Luckily, I was already going VERY slow (20mph) because it was dark and I was driving alongside a wooded area and the deer only slowly trotted out towards the road (before seeing my car and turning back).

These freaking things have NO natural predators (i.e.: pumas) AND have the animal rights activitist in their corner; therefore, we'll continue to be overrun by them.

I have seen that on the news about the people that don't want the population thinned out by hunting. Maybe after several animal rights people suffer Deer collisions, they may see things a little differently. I happen to like Venison but I am not a hunter.

How about blaming the driver as well. The Deer is a wild animal and has no ability to reason. The tires are not to blame unless everybody that has them on their cars have avoidable accidents. The driver has most of the control in the operation of the vehicle. If you break a telephone pole, you had to be going quite fast. The bottom line is that you hurt your car and you were able to walk away from the wreck. The same would apply to me if I had a collision with an animal or object. I would not blame the animal or tires if I was at the helm.

I would take my chances at attempting to stop in a straight line and hitting the deer rather than trying any high-speed "avoidance countermeasures" and end up worse off. You'd be surprised how quickly the deer reacts to the sound of a horn rather than a set of lights bearing down on them.
I also live in an area with a heavy deer population. At night I drive a bit slower and with my high beams on, when appropriate.

I live in NJ as well and see deer crossing the road at least once every two weeks. We all know the blowtenzas are horrible tires especially in the wet, but it is the responsibility of the driver to know the limites of his car and tire combo. the deer is a wild animal and crossing the road is just natural for them. its the job of the driver to have his car under control at all times. if you broke off the pole you must have been going pretty fast. I am glade you didn't get hurt but dont blame the deer or the tires.

Sorry to hear about your misfortune. Yes, deer are a population problem in other parts of the country too. Deer season needs to be extended.
I hope they total it. I'd hate to repair it and try to sell it.

I agree with you about that. We are accepting the responsiblity to operate a motor vehicle, it's not a prilivige as you all heard this one, it's a responsiblity.

Hey, you know what? All you guys who say I should be to blame can go **** yourself, you try coming around a tight turn and see a big deer in your way, and see what you would do!

I've driven cars for years, and have even taken offensive/defensive driving as well as a tactical manvuers driving course (bodyguard training), if I had seen the deer I could have avoided it altogether (the deer and the crash).

But, you know what? Blame whoever you want, but in the end, I'm the one who was driving, I'm the one who crashed and I'm the one who has to live with the fact that I lost my car and I'm the one who almost died a day before his birthday.

So, unless you were in the car, don't add your 2 cents as to who was to blame.

Yo Jester, I totally agree with you. It's really easy to open the flapper when it ain't happened to yours truly. Even though they might have said at first that they're sorry for you, it's obvious what they said later that was meaningless. What they lack is empathy. It reminds me of the movie the Nuremberg trials when one of the characters said "I never knew what EVIL was until now. It's the lack of empathy."

Screw the damn car and the damn deer, your life is worth more than all the cars or deers in the world, so if YOU believe that Nissans are back luck, if YOU believe the deer screwed you, that is what counts, not what any other yahoo says.

Like the man said: Live long, my friend, and prosper.

Sounds like you still can't grasp reality. If you could jsut take the blame for driving too fast in a "tight curve", you could see why we made the comments that we made. I have been driving for years too. If you don't anticipate potential road hazards in curves, you will sometimes be faced with situations such as yours. If you had been driving a little slower, you could have possibly avoided any collision alltogether. You can't learn everything in a driving course. We all know how us Maxima drivers like to push our cars from time to time. Yes, you almost died in your crash. If you are smart and mature, you will learn from it and move on. As I stated before, you came out of the crash all right. If you can't take any constructive criticism, don't post in the forum and expect everybody to say things that you agree with. It's not personal. In a forum like this, everyone is entitled to add their 2 cents. We as Americans like to play the b;ame game way too much. Be responsible.

For any of you guys that roll to/from AC on the GS Pkwy @ night, checkout the grassy areas on the side of the road; you'll see HERDS of deer. If they EVER get spooked and run onto the road, there'll be several fatalities easy.

So I was speeding even though I was going 5mph under the posted speed limit?

And as far as Constructive Criticism, I am able to take it, but unless you've lived in Jersey and have dealt with the insane deer population, you have no idea what the hell you're talking about.

Blame Game? So if this had happened to you you'd be taking full responsibility?

I never said that you were speeding. I simply said that if you broke a telephone pole, you had to be going fast. Reading is fundamental. I don't have to live in your area to understand the nature of Deer. On my daily drive to work I sometimes encounter Deer. I have nearly hit more than 1. The only thing that helped mr was the fact that I was lucky enough to brake early and hard enough to avoid them. I call it the blame game when people blame everything or everybody but themselves for what happens to them. If you had read my earlier posts, you would have read that the same thing I said about your accident would apply to me if I was at the helm. So you see, I'm not picking on you as you might think. It's just the way you delivered your post. This is where I end it. I'm not here to argue.

Good place to end it... If I were in his shoes (and I have been), I'd be ****ed about the deer population as well. I heard on TV that a recent study showed the deer population was larger now than when the Pilgrims landed.

Let's cut the heards to proper levels and put a deer steak on my grille.......

Reminds me of that quote from Austin Powers 2...

I think it's pretty insensitive to accuse someone of being any less than responsible in a thread where he's obviously shaken and concerned about his car situation. I've hit a deer at 15mph once... came out of nowhere. Broadsided the front/side of the car and totalled it. 15mph. It scared me so bad I didn't drive for a month. Don't jump to conclusions. It seems to be typical org fashion to bash someone at any opportunity... perhaps this wasn't the best of opportunities. geesh. I guess it's his fault for posting on the org... ??? That's pretty much what you said, charlie...

I know I'm a girl but I know how to drive and even at 15mph I couldn't miss the deer. You just never know.

Just because someone had an accident and is shaken up does not remove accountability... I feel that the reason some people here came down so hard on him is because it is very obvious from the post that he was driving well in excess of a safe speed for the road conditions. After all, he lost control of the car, and snapped off a telephone pole.... he was NOT going 15 mph.

So at this junction we have two options... we can pat him on the back, lay all fault with the municipality, firestone, nissan, deer, God, whatever, while telling him he is a flawless driver and is not at fault. Or, we can be thankful that he is alive and express our opinion that we feel he might need to carefully evaluate his role in the accident, and what preventative steps can be taken next time to either avoid it completely or mitigate the sitation. In the end, I (and the law mostly) agree with the previous posters. He is the ultimate agent responsible for the safe operation of his vehicle. Avoidable or not, the accident is his fault, and from the story he told, it does sound lke excessive speed was a major factor in the accident. Honestly, insensitive or not, hearing the truth, regardless of how harsh, from other people that know a little about cars, some of which he may have come to already respect on the board might save his life come the next deer.

I too feel sorry for him, and am sympathetic for his car troubles. But, in this respect, despite your best intentions about being sensitive, you are doing the poster a great dis-service by blowing colorful bubbles about the reality of the situation.

Thank you for your input. I don't think it's insensitive at all. It is only the other side of the coin. Blaming something or someone else may make you feel better but, I see it as a cop out. The original poster was blaming everything but himself. Life is full of lessons to learn from. He was fortunate enough to come out of his accident with only a badly damaged car. What you call bashing, I call offering a different perspective. You percieved my post as blaming him for posting here. Not true at all. I simply stated that he should shoulder most of the blame for the accident instead of blaming other things. If you are/were offended by anything I posted, I can't help that. I never intentionly offend anyone.
