Deer Suck!

After all, he lost control of the car, and snapped off a telephone pole.... he was NOT going 15 mph.
So at this junction we have two options... we can pat him on the back, lay all fault with the municipality, firestone, nissan, deer, God, whatever, while telling him he is a flawless driver and is not at fault. Or, we can be thankful that he is alive and express our opinion that we feel he might need to carefully evaluate his role in the accident, and what preventative steps can be taken next time to either avoid it completely or mitigate the sitation. In the end, I (and the law mostly) agree with the previous posters. He is the ultimate agent responsible for the safe operation of his vehicle. Avoidable or not, the accident is his fault, and from the story he told, it does sound lke excessive speed was a major factor in the accident. Honestly, insensitive or not, hearing the truth, regardless of how harsh, from other people that know a little about cars, some of which he may have come to already respect on the board might save his life come the next deer.
I too feel sorry for him, and am sympathetic for his car troubles. But, in this respect, despite your best intentions about being sensitive, you are doing the poster a great dis-service by blowing colorful bubbles about the reality of the situation.

In fact, all those drivers that hit a child who steps out from between two cars should go to jail for manslaughter as well. They were driving and hit them, correct?
Come on guys....He had an accident. He did not blame anyone until people started shoving his face into it being his fault. So what, it was a deer. It could have been a tree laying in the road or some drunk stopped around the corner for no good reason. He reacted to it and the result was a wrecked vehicle.

I just think that sometimes on the net people get a little big for thier britches, that's all. Jester's cool and my husband posts with him on other forums all the time. I didn't mean to offend you either, charlie... I just think that perhaps everyone could have kept thier presumptions about his driving to themselves. If you didn't have anything nice to say, you could have said nothing at all
Jester sorry about your car and your ruined birthday. This could be a blessing in disguise you know... don't get too down on it.
Oh, and snapping the telephone pole is more likely a testiment to the Maxima's durability than your speed at which you were travelling when you hit it. Be thankful the pole snapped... it likely absorbed a lot of the impact from when you hit it. That's why they coil the copper on the inside of the poles instead of having a solid rod through the middle, it helps with impact.
And again, sorry charlie

Jester,
I see that you're from Morristown, NJ. I lived nearby in Chester until about a year and a half ago. The deer situation is definitely a pain. They are everywhere. My parents have deer wandering on the front yard almost everyday. Everyone in my family has had a deer hit including myself, though not up there. Knowing the area, I think the suburban sprawl is to blame. New houses are being put up all of the time and the deer have no where to go. The strange thing about your accident is that you may have been better off just hitting the thing. That's never the natural reaction however. In any case, hope everything works out for you.

What to do in this situation
Working for an insurance company I must advise you all what to do when confronted with a situation such as an animal in the road. It is very sad, but unless you are 1000% sure (the extra zero is on purpose) you can control your vehicle, always just brake. Do not swerve. If you hit it and nothing else, it is a terrible thing but it is a "Comprehensive" claim. If you swerve, save the deer, but hit a tree, that is a "Collision" claim because you were still responsible for changing the car's direction. You will feel better about yourself about yourself for saving the deer but a collision claim can be a chargeable accident that can cost you thousands in insurance premiums for the next 3 years. I work for a NJ Auto insurance company that deals with this all the time.
I personally recommend that everyone carry a comprehensive deductible of $250 dollars or less. It is usually not that more expensive than a 500 or 1000 deductible. And no, you do need to have the same deductibles for comp and collision. However, carrying a collision deductible that low is very expensive.
Two lessons to be learned:
Low Comprehensive Deductible
and
Always hit the deer.
Sorry to hear about the accident man. Best of luck with the aftermath.
