3.5 auto trans (cold slip) soft shift

hey,

i noticed when i drive my maxima hard sometimes 1st gear winds way out before it shifts.....and seems to shift out alot softer than my 3.5 alti.

is this normal to slip when the car isn't totally warmed up?

also, is it doing damage to the tranny when it slips? seems it would.
any of you guys have this problem? i have an appointment with the dealer on friday. but im affraid they are going to say "we can't duplicate the problem" because you have to floor it for it to slip, and it also has to be when the car hasnt been drivin hard or fully warmed up.

btw, put my stock intake back (injen was what i had) for the trip to the dealer.
the car seems to be alot faster atleast down-low and doesnt seem to slip "as bad"

My 03 does the same thing... when the car is cold, the 1st-2nd shift is VERY soft and long. When it warms up it speeds up some. I try to avoid full throttle until it has warmed up, that long soft shift can't be good.
