VIAS intake sound change

This is to you guys who know your VIAS is working, had it fixed or def. know its not. Does the sound of the engine/intake change enough to hear it when it opens at 5k? My g/f has a 2002 2.5 altima and on that car its def. very easy to spot, i didnt even know the car had it and wasnt looking for it just had the pedal down one day, it got noticably louder at 5k. Reason i ask is because when i have someone push the pedal i can see the little arm and solenoid on the side of the VIAS box move back and forth but driving, nothing happens, it sounds the same all the way through the powerband so i dont think its working.
Is that what usually happens? For example i was getting on an on-ramp and there was an eclipse v6 behind me who was just driving like an @ss and went to pass me, we wernt racing or anything but i was in 3rd and floored it to see if i could stop him passing me(3 lane highway btw) stayed in 3rd til 6500 and he just drove by me. either their a lot faster than i thought or my car is slow

Not super noticable, because it's loud at 5k, but yes the sound changes.

The harmonics are supposed to be different but it gets very hard to tell. Your brain plays tricks on you naturally...
