Check the fluid level (when hot). This can occur with LOW or HIGH fluid level, must be in the middle of the dipstick.

This will be my last Nissan...and that is painful because I think they are great cars!

Anyone else ever have a trans issue like this before?
I thought it was 60k powertrain and warranty should cover this since the start date was before the warranty period expired. My .02

You are 100% correct. The warranty is 5 years/60,000 miles. The issue started well within both ranges.

The dealership just responded to my Better Biz Complaint.

1. They state that the trans fluid at 42,000 was dirty and low. I check fluids weekly, so the low bit is BS.

2. Fluid was changed around 30K, so would another 12K cause total trans failure?

3. They said that they are not covering the issue under warranty because of my "failure to provide maintenance to the vehicle." By maintenance they mean changing the trans fluid, which is BS since again, it was done around 30K, as recommended. Does it state anywhere in a vehicle warranty that the owner must provide regularly scheduled maintenance?

The saga continues...

I might be in the same boat.

Tranny has hesitated 2x in the last 2 weeks, but only from a stop, after waiting for a left arrow(both times).

I have read through this thread and found a handfull of people with the 2k2 auto trans issue. I am trying to collect some information on this and if any are willing to help, I would greatly appreciate it.

I believe there is an issue with this transmission and I am pursuing the legal route to deal with my own 2k2 trans problem. Class action is a possibility. If anyone wants to send me info about the problem, when it started, what the dealership did, did it work, and did anything resolve the problem. I will keep everyone informed of what progress I make. A preemptive "thanks" for your help!

You will need a lot of people to make that work. Mine failed after the warranty was over. Plus, my car was modified. I have never taken my car to a dealership, besides once for the timing advance modification.

Nissan is a major corporation. They probably have ways to prevent this from getting to court. Average class action lawyers will probably not fair well against Nissan's lawyers, if it does get that far. This is my opinion. If you decide to pursue this route, good luck to you.

Magnuson-Moss Warranty Act

Here's the scoop. Several agencies are now investigating the actions of Frederick Nissan and Nissan North America. As it turns out, the law under the Magnuson-Moss Warranty Act is quite simple. If the issue was raised to the dealer prior to the expiration of the warranty, the warrantor is obligated to repair the vehicle. It needs to be appropriately maintained, with records, and a record of issue prior to the warranty expiration. In other words, those that have had vehicle issues, if they are raised prior to the warranty expiring, and there are appropriate maintenace records, the issue should be covered. I am awating a response from Nissan now and will keep you all informed.
