Looks like AEM fixed the problem. And the fix isn't necessary on AEM Air Bypass Valves purchased after 01/31/01.

It's cheap insurance against hydrolock!
I suffered hydrolock on my 92 Nissan 300ZX a couple years back. It caused my car to stall and the interior got flooded by the fast rising water. My insurance company totaled my car because they said it'd be too expensive to fix. I ended up buying the car back from them and rebuilt the engine myself. Now the car looks and runs fine. I learned a lesson that time so I'm not going to take a chance with my new Maxima. Because I installed a CAI on it and the intake is mounted down low, I will definitely install a AEM bypass valve. I called AEM and they said not to attach the valve to the MAS. You can take a hack saw and cut a section of the intake pipe somewhere near the battery and insert the AEM valve. It's cheap insurance against hydrolock. Take it from someone who knows!
