Do safety recalls expire? - Camshaft position sensore bank 1 error P0340

I am in Toronto. My 2003 Maxima (purchased second in 2010) has CEL on, the code is P0340 (pending). I remember it was on probably last spring as well, at that time I just cleared the code and it never came back until recently.

Before I clear the code again, the car stalled at traffic light three times. I searched and realized that there was a recall on the sensors:
Transport Canada Recall Number: 2003267; Units affected: 74,143

2001-2003: On certain vehicles, the circuit board for the crank position sensor may have an improper solder joint. This could cause the Service Engine Soon warning light to come on, create a no start condition, cause reduced engine power, or cause the engine to stop running without warning during vehicle operation. Correction: Dealers will replace the crankshaft position sensor and both camshaft position sensors.
Also there is a Nissan North America recall campaign NTB03-124 (google for NTB03-124.pdf). My Vin is in the range.

So I called my dealer they told me no recalls for my car. I also called Nissan Canada, same answer.

Now my questions, do safety recalls expire?

I have printed out the recall pdf and Transport Canada Recall # 2003267, and I plan to show these to another dealer and see if they will help me.

If not, can I sue Nissan Canada?

They will help you. About a year ago I had the same code and I had my dealer run the VIN to see if the car had the recall done and they said no so they replaced it for free.

If its been done they don't need to do it again. They can check this but its more work for them to go digging.

service letters/tsb's expire but recalls don't, I'm pretty sure

I brought a copy of the recall that I printed out but the guy just used his computer to look it up anyways. He said they're legally required to fix it since it was a safety recall. This was in the US but it shouldn't be any different if the same recall was issued in Canada as well.

A crank sensor fault is not a safety recall.

It's just a recall.

There's a big difference

Well that's what the service writer said to me lol. He said he was fixing it for free so I wasn't gonna disagree with him.

Good luck. I followed the recall path and was informed by a Nissan of North American phone rep that based on my VIN the car did not qualify. Even if it did and they refused to replace the sensors is it worth the hassle?

Both cam position sensors are easy to get to and install and cost around $70 each so in the meantime you might wish to do the work yourself. I just did this on my son's '03 and it now starts easy and does not stall like it used to. Afterwards if you feel it is worth the time and energy to pursue getting your money back, go for it.
