Accident...Now What?

I was on my way to work today in the afternoon and there were clouds, but sunny for the most part. I was just driving along the outside lane when someone decided to brake for no reason. I was more than 5 cars behind and luckily caught everyone slowing down as I began to come to a stop when I saw this big white sedan barreling down towards me. I thought to myself "They'll stop." Nope. The car was still coming. Then the car braked and lurched foward, but it was to late. Next thing I know my car goes forward and is headed towards the car in front. I quickly hit the brakes while recovering from my head hitting the ceiling. My radar detector (mounted to the windshield) flew under the seat, my ashtray ended up on the floor of the passenger seat as well as my phone. In conclusion, I had better days and Impalas are quite strong. My trunk won't budge, tail light (LED might I add) is cracked, driver side tail light probably disconnected and I can't get back there...I put so much time and money into this car and now it's like for what? I'll contact the insurance company tomorrow and see where this goes. What do you guys think?

More then likely insurance adjuster gonna total it out specilly if frame is bent at all.

I can't stand them dam people! i been rearended one time hard like this every since then i stair at every mirror every couple of secconds!


good luck! if they total it out you'll get bluebook value like 4,200 and then u can buy max back and get salvaged title but have it pulled n fixxed for bout $1200.

If this is a 5.5 you better demand at least 7,000. State farm is handing out 6,700 for high mileage base models in OK condition.

Yep. I got about $6500. You may want to consider swapping out any valuable bits. My insurance company didn't want me replacing anything on it after the adjuster looked at it. Not that I was particularly inclined to do anything to it during the middle of winter.

Get the cash, buy your original car back, buy a better condition maxima, swap parts, unload original car to junk yard for cash.

Then buy a dash cam for future idiot drivers.

Some of my friends doubted it would be totaled but after I told them there was frame damage they mostly agreed it would be totaled.

Yep its a 5.5. 134,5xx miles. I'm definitely not settling for anything less than $6,500.

That's the range I was looking at. And two minds think alike! Definitely going to swap out every valuable thing I can. Somethings like the newly installed radiator and battery unfortunately cannot be changed.

That's what I was thinking. But I've been advised to take the cash and look for another car. I was looking into a G35 or 350z as i saved a little cash but I wanted to mod my Max some more, then a cellphone and an inattentive driver ruined that plan. But the dash cam is FOR SURE something I'm going to invest in the future!

from the look of how the trunk lid is buckled in and still latched, and only going by the pics you posted, i'm going to say that there is structural damage. If so, the car will be more than likely totaled.

This is the dash cam I run. Its cheap and the best I have seen and used. You need to buy micro sd for it. I am running 32 gb. It will record over itself over time. But it is the only true HD 1080P dash cam they make for this price. Also it starts and stops based off of it the car is on and detects a car crash and locks the footage.

I bought this after numerous dumb asses doing stuff in front of me or messing with my car. I don't like phone apps because it will drain the crap out of your battery and what do you do if you get a call? Plus I don't always need to turn on a app. This is automatic!

Oh and that camera has night vision which apps do not. It is a

It's totalled. Make sure you get an attorney. Since it wasn't your fault, he'll be able to get you a good amount of money from the other driver's insurance company. Also, go to the doctor to get checked out, even though you may feel ok.

Agreed. I guess I was just indenial for the most part. Her Impala wasn't even dented at all.

Sheesh. I'm definitely looking into the one you mentioned. I had a hard time finding one that's perfect at night for the right price. The one you mentioned also has an option for 2 year warranty which is appealing to me! And there are to many stupid drivers here in Florida. It's like a Driver's Ed instructor is in every single car teaching people how to drive.

I was thinking about getting an attorney but I've been researching a lot. With my meeting with the adjuster on Thursday, I plan to bring my maintenance log, receipts of all the mods I've done, and what cars are going for in my area. I'm not settling for anything less than $7,000 since most Maxima's in my areas are listed in that range. And I immediately went to Urgent Care after the accident and got checked out. I will update on what happens next. Thanks for all your help everyone!

Another thing, do you have any picture of your car with the brake lights on? It wouldn't surprise me if the person who hit you blamed you for having tinted lights.

At the moment no. But they aren't two dark as I only applied 2 coats. And if they were dark to the point where she couldn't distinguish if they were on, she without a doubt must have seen my 3rd brake light

Well it's official. The car has been totaled. They are trying to offer me $5,800 but that's not going to happen. Meeting with my Claims Generalist Monday to push for $7,000.
