Filter question

My question is about the air filters upgrades some people are putting on there Max. The upgrade where you remove the stock filter box and use the K&N filter setup .Is this setup 50 state legal,or do you have to put it back to stock for inspection.
Having my new 2002 max for a couple of weeks now. I would rather not start taking parts of the engine compartment. The car is quite fast stock, about 200 miles on it still breaking it in.
I am not looking to take it to the track or drive around trying to blow everyone away, but it is nice to have the power when someone is messing with me
If I was to buy a K&N filter to fit the stock filter box would I get some improvements with this setup or is it not worth it.
Thanks for help

The nice thing about my new Maxima,It is a wolf in sheep's clothing.
