Need Opinions on a Sale gone BAD

I purchased 1995/1996 Red Clear taillights from kurtocbain59 on Dec.27th, received them today January 8th. They show up well packaged but I open them and see that there is a HUGE crack in the lens (www.staythenite.com/index9.htm) for pictures. Am I out of line to request a refund considering they were sold to me in perfect condition?

I mean I paid 150$, that's a lot of money to just throw out, expecially for a starving college student.

well, you should take it up with the seller before posting...but if the box was intact then this isn't right to sell broken lights...
also, in my opinion, the ones on his car look a lot different than the ones on your pics....

they look 10 times different i just noticed that too

Oh yeah...

On his site he has David L's - he sold me his old homemade set...but he told me they were in perfect condition. He has taken the pictures of his old set off the CarDomain site. This kid is almost impossible to get a hold of, I email IM constantly...hopefully this wont need a lawyer.

EDIT: I'm not sure if they were damaged due to shipping BUT it sure looks to me like the were cracked where the kid seperated them. I hope for his sake he shipped these things with insurance...

ahh no wonder, sounds like he falsely advertised them bein in perfect condition, i mean why would he have a second set in the first place unless he fubar'd one?

Yeah I was wondering what happened, also he told me that he tried to ship them on a monday and the postoffice called FRIDAY and told him that they needed more packaging...or so he says...he delayed shipping FOREVER...and yes these things are thoroughly FUBAR'd...what a shame.

Don't want to be a **** but that's what happens when you buy stuff from people who've been members for only a few weeks. Anyway it was false advertisement and seems like he won't return your money. He was an a$$hole when he sent you that garbage and he'll be an a$$hole about giving back the money. Then again you could always ask some ORG members from his neck of the woods to pay him a visit.
