legal question... max is ****** up

legal question... max is ****** up

on saturday, i went to the warped tour down here in ft lauderdale, fl. the parking was totally out of hand, with nowhere to park, so the ampitheater where it was being held had people parking all over the place. i followed a line of cars, being waved thru by attendants, and ended up on a grassy island in the middle of some parking lot. as i was lining up to park next to a few other cars, i hit a tree stump, pretty hard, which was hidden by grass. it was about 6-8 inches high, and about a foot in circumference. so now my max is at the repair shop with a whole list of damages, it wont drive, needs a new bumper, the list goes on and on... the body shop says just by a rough estimate its going to be well over $2k. my question is, can the ampitheater be held responsible? i was following an attendants lead, and he directed me to the spot. the theater said they werent going to pay for any damages, but if i can sue, i will.

If they will pay for the damages why would yo want to sue?

who said they were going to pay for the damages? i sure didnt say that, and neither did they.... you know, thats what im asking

If it was on their property, and their attendant pointed you to that spot, I cant see how they can deny it. I would say talk to a lawyer, because it sounds like they will deny it until pushed. They have insurance for things like this, so it shouldnt be a huge deal.....

Jeez, where the hell did they make you park? I was there, in fact I got there pretty early and it was still only a 2 minute drive out of the whole thing. Hope it all goes well, but I wouldn't be optimistic. At least the show was good.

Sorry my reading skills are below basic. Like white max said they do have insurance for that. Also it is very important to talk some one of importance(not john the janitor) and let them know you mean buisness Public places are liable for any actions occured on their property unless it is stated otherwise in an operation policy.

Go back to the site and take pictures of the stump. Consider talking to a lawyer or discussing the situation with your insurance company (which I assume you will use if you don't go after the amphitheatre parking.

go small claims

I would suggest the small claims route. Landlords and such blow off judgements against them in that court but businesses don't, plus you can find them. Plus the justices, who often have no law degree, tend to side with the plaintiffs when it's them vs. a business.

Look at it this way, if you ran over a nail in a garage, would they be liable for your tire? Probably not, because having a nail in your path is not unreasonable, it happens. But if they are gonna park cars on grass, they need to make sure there isn't debris which will damage the vehicles. Waving you on as your car goes down a ravine, can they say they're not responsible? How about over a cliff into the ocean? Let's get real.

You do have to write off the $ as a total loss. That way, if you don't get anything in small claims you're prepared for it. If you get the full monty, or half, it's gravy. Good luck. I can't stand shys, make money and take no responsiblity. FL small claims

thanks a lot guys, i thought they should be responsible... what i didnt tell you also was that the cops there were absolutely no help at all, and they said there was nothing i could do, and didnt want to fill out an accident report. and to cap it all off, my front right tire was buried in some kind of sand trap, all the way up to the top of the rim. im seriously ****ed, and youre right, if they were waving me on and told me where to park, they should be held responsible. so im going to try to file a claim somewhere... ill keep you posted so if this happens ot anyone else, itll be on record

Find out who their insurance carrier is and report it directly to them or to their insurance agent. I work for an insurance company and we get claims like that every so often. From what I notice, we do make settlements majority of the time (especially in cases similar to yours).

there is no use talking to cops when something like this happens to your car .. best thing to do is to get the attention of some manager or higher figure of the ampitheater and tell them u are not leaving until they do something..
