Just got a ticket for $245...........Oh well

It was totally my fault and my radar's fuse blew a couple of days ago and I didn't fix it. I live by my radar and I should have chilled while it was inoperatable. I basically pulled into traffic accelerating hard so I could hear my intake roar and I see a motorcycle cop at the end of the road waiting for me. I said to myself, "Damn!!!!" and just pulled over and turned off the car. The cop (an old guy, must have been 70 years old) says, "I clocked you at 57 and you were well up into the 60's." I said I was sorry for that but he still gave me the ticket. I've gotten warnings in the past but the cop couldn't even check my record because he didn't have the computer.

It was totally my fault and I will go to court to have the ticket price dropped. I'll just get a copy of my driving records and show that I'm cool most of the time. This is my first ever offense in MA so we'll see what happens.

The price of the radar definitely has paid for itself but I was just stupid for not fixing the problem when it occured.

I think its $10 for every mile over the limit but the cops seem to put whaever they want. The ticket was for doing 57 in a 30 zone. It kind of dumb that the limit is so low in that area of town because its a road the eventually leads you onto I93 and its non-residential.

I think the best thing for me to do is hire a lawyer to keep from having to pay more in the long run.

In WA State, 57 in a 30 is reckless, and usually they tow your car and put you in jail for a few hours, and let you go under PR.

And you lose your liscence for a year.

I dunno about MA but if its anything similar to MD this isnt a DWI case, or a hit and run case or even a evade the police case. This is a speeding ticket case. Save your money from hiring some sleezeball lawyer. All he's gonna do is stand up there and say exactly what you could have said. I did this once, and I felt I blew the money spent on him. Each time after that I just went to traffic court by myself. For the record I have one point on my license, that will be cleared in about 1.5 years and that was for burning rubber. I've had 2 speeding tickets in my life (lets hope it stays this way). One was when I was 16 doin 80 in a 40. The next time was last year (at the same spot :rollseyes for 65 in a 40. I've also been charged with running stop sign, negligent driving (long story) and some equipment violations (remember headlight covers?). On all of the cases except the 80/40 case (speed was lowered though) I got probation before judgement.

Oh yeah, another thing, you dont need to show up with your driving record to "show" the judge anything. More then likely s/he will have a computer screen infront of him/her that can pull your record with a few strokes.

Definately to court regardless, especially since you say your driving record is clean. If the officer does not show up plead not guilty. If he is shows up you may as well plead guilty with an explanation. Hopefully by good luck (yes luck) you will get a judge who will cut you a break and is having a good day.

***Disclaimer*** I am not a lawyer, paralegal, law student by any means. However, I have been to court my fair share in my lifetime for various things and am sharing my experiences. What worked for me may not work for you.

So should we trust the judgement of someone who's been in and out of courts all his life?

Keep laughing cause you will notice that out of all the times I went to court except for one, I have gotten either not guilty or probation before judgement. And even that time the points and fine were significantly reduced.

Thats a ripoff. I got 2 tickets a couple of months ago. 1 for drag racing and 1 for speeding (40 over). I had to pay 105 for the speeding ticket and 150 for the drag racing ticket. Both of them went on court supervision

Oh yes, like everything else here in Taxachusettes you pay top
dollar. When I first started driving about 16 years ago a speeding
ticket ran you $50.00 here. In the late 80's a guy named Dukakis
drastically increased the fines for speeding and now everyone gets
stiffed.

Intakes at 6K RPMs in a max will make you do crazy things like this.

I hear you bro'. Don't worry, happens to the best of us. I must have been having a bad day yesterday because I was driving very agressively to NYC, and almost had an accident. I even got out of my car and told some dude to shut the **** up with his horn. Immature? Yes. Dangerous, no, he was with his little girlie, he should have stepped out and impressed her with a beating from me.

Anyway, I drove 110 mph on the NJTP, which is why I know I wasn't being myself. I almost never speed more than about 70-72.

Thanks for the support fellas. The fine in MA is that you get charged $10 for every mile over the limit. I'll just head to court and tell the judge my son had diarea (which he did have a tummy ache ) and that I was trying to get him to a bathroom. I just didn't bother to tell the officer that because what are the chances he would believe the story anyway?

I talked to DMBMaxima after it happened and he thinks my first offense will be waived anyway so my insurance won't skyrocket. We'll see.

Update!!!!

I just got off the phone with my insurance agent and they say that my insurance would go to a step 10 from 9 (step 9 is the best you can get in MA) and I would have to pay like $50 to $60 dollars extra per year on just the Maxima so I'm going to scrap the lawyer and just go to court and tell my story. This is definitely not worth getting a $900 defense lawyer. I'll just chill out in the future.

$900??? You could probably get divorced and declare bankruptcy and take an atty out for lunch for that much!!

Yeah, just tell your story. I got off in MA once (Pittsfield). Also got a warning out in those parts too. MA cops are cool. Not like PA. I was in a hurry this morning and blew a light, doing 55 in a 35. Cop was right there. Did he even bother to do anything? Nope. I'm gonna learn my lesson anyway, don't know what's gotten into me lately, I'm usually very responsible. This lady got under my skin....like Christopher's deal on the Sopranos I guess.

You probably wont get off the ticket without a lawyer. 900 dollars for a traffic lawyer is a huge ripoff. I paid 250 for my lawyer and he is top notch. Its not like your going to trial with the lawyer. Your attorney will probably work out a plea bargain with the prosecutor and it you will be out of court real quick.

Congrats. Did the cop show up?

hehe You were worried about your step 9 going to 10? Try coming up to me in step 21 and see how that feels.

That's ok dude.

The cop doesn't show up in Somerville, they send a rep of the department (another cop) so you can't get off.

From the OT Forum:

I was found not guilty.

The good thing was that it was a slow day at the court and they called each case in one at a time, also there was a rep for the Somerville Police Deptartment instead of the officer himself(I guess this is done to get rid of all the lies of "If the cop doesn't show, you'll get off").

The officer starts with his shpeel of what the officer wrote in his report and the Magistrate is there to let me plead mine. So I tell the Magistrate, "This is the first time I've ever gone throught something like this so I brought my driving records to show that I'm a responsible driver. I had my 4 year old in the car and was rushing to get him to a bathroom at the nearby Kmart."
She says, "I've checked your records already and I'm going to give you a big break this time but you need to be more careful having a child in the car. I'm finding you not guilty." I said, "Thank you and have a good day" and broke the hell out of there. Phewww!!!!
