The guy tried to tell me it was my fault because the little aluminum bar that goes from the bottom of the fender to the inside of the car was unbolted (don't know when that happened).
I tried to explain to him that it doesn't matter, there was enough force there to bend sheet metal!
he wouldn't listen.
What should I do to argue this case?

After reading thru that.....HOW did that happen?? Any auto here in CO ive been to has nothing that can scuff wheels or even come close to your car.....what the heck kind of auto was that?????/

Well, looking at it after my car was already damaged, they had this long roller with a scrubber on it that comes out and scrubs your wheels - it travels parallel to the car, then pushes in on the car to clean the rims. I think it pushed in, caught underneath the fender, then when it pulled back, it ripped the fender apart.
Still wondering what to do about the legalities and proof of it.

sorry to hear that...but I have to say I've been using the same drive-thru/park-in car wash at my local Exxon for the last few years and never had an incident and that was lowered 1.8" and with Stillen front lip!
but yeah you have to be careful because each one of those washes differ at each station, I watched the entire process and all the moving parts(brushes, scrubbers, etc.) on another car before I put my car through it the first time!

You should take video footage of the washer in action and then get estimates of the damage. I am thinking that you will probably have to go to small claims court unless you pay a lawyer to put the squeeze on them. Either way, it's a pain in the ***.

Are you in school at a university? Some (most?) universities have lawyers that will undertake cases such as yours, free to the student. I got into a legal wrangle with an insurance company many years ago when I was a student at UTexas. It's amazing how a letter from a lawyer gets the attention and cooperation you deserve. Well to make things a bit easier for you, being that the damage happened on their property and from their machine, they are liable. How can the guy prove that the machine didn't pop out the screw that was holding your fender on? Talk to the owner of the place also.Originally posted by iansw
