Is Nissan trying to Screw me? Need Advise.

To make a long story short:

I go to my car today and I go to push the clutch in and it didn't come back out. Sent it to nissan because I called a guy I know at another dealer and he said being that I had the coverage send it there.

Nissan dealership (Bar Ridge Nissan) says they have to remove the transmission and then see if it is the clutch itself or the master cylinder of the clutch. Then they said if it is the master cylinder it is covered under warenty if it is the clutch then it is not.

I called my friend at the other dealer and he said that is bull because it is a hydrolic issue either air in the line or a leak.

Do you think they will try to screw me and say its the clutch just so I can pay out of pocket.

I know why didnt I take it to my friend that is because it's in Peekskill and I am in Brooklyn.

Need advise.

Doesn't sound like a clutch to me.

I second that, I can't see how a burnt clutch would cause that.

That is what my friend said at the other dealer. He said it is probably air in the hose or something like that but not the clutch. So I shouldnt authorize them to take down the transmission, I should tell them to check the lines first to make sure there is pressure correct.

Yeap i would do that.. sounds like a leak somewhere. If they don't want to do what you tell them then it might be worth the drive to another dealer.

Vyrus - I can t drive the car it's a manual trans. and it's the clutch pedal that is stuck in the down position. If I could drive it I would to another dealer.

Erk I mean tow it, granted another dealer isn't too far away. Because if they tear it all down and say it's not their fault, you'll be paying for the labor wether or not they fix it.

well the ve5 im buying had a similar problem, except it happend in the middle of bqe. the guy had to lift it off the ground a few times to get it home... he said he replaced the MC and it never happen again.

what about the slave cylinder? could be that, the master, or air in the line but there is a leak and its gotten to the point where there isnt enough fluid to push the pedal back up.

check your slave cyliunder and master cylinder and see the level of the fluid (take the tops off cause the residue could create the apperance from the outside that its full).

I will find out tomorrow when they call me and i tell them to check the mater cylinder and slave before they do anything.

Years and years ago I had what sounds like a similar problem but it was strictly a mechanical issue. There was a bushing or whatever that physically connected the clutch pedal to a rod which was obviously linked to the clutch itself (forgive my terminology if it is wrong as I'm far from automotive "intelligent"). It "broke". That was replaced and the clutch worked fine after that. It was a cheap part and minimal labor to replace it. Just something else to check.

Well I got the call today and it was the clutch slave cylinder cable witch was bad and it is under warrenty

I was going to say.. sounds like a hydraulic issue, which is 100% outside the transmission. no need to remove the tranny to check that out.

glad it was under warranty. it's not that difficult or expensive to fix as long as you don't pull the tranny to replace a $10 hose that sits on top of it!

well I got my car back and they fixed the hose without a problem under warranty. But now they gave me a new problem, when the car is warm the rpm's start to futter toward 0 rpm's and the car shuts off on its own (good if I was parking) not good while I am waiting at a light and the car shuts of on it's own. So time to take it back to see what they say.

Ant- i know.

So here is an update they crashed the car and they are saying its my fault because I have auto-start on a manual car.

Here is what happen, they left the car is 1st and when they went to go move it the tech push the button to start the car and BAM right into a Dodge Durango. Also swipping the the bumper of a 300M, which scratched my car on the driver side all the way to the back wheel well.

Called the ins. people and I am gonna find out what they say on Mon. or Tues..

What a load of bull ****...that dealership is responsible for what happens to your car while it's in their posession.

Were they running the starter the entire time of the incident? If you attempt to start in gear the car will leap once or twice and stall. The only way it would move enough for that to happen is if they started the car and decided it would be okay to drive it with a non-working servo system. That is BS. Either way they are fully responsible. Anyway, when you get the situation resolved I have a spare slave cylinder and clutch line. I can send them both or just one. My guess is that your soft line ruptured or is leaking severly.

Broaner - They fixed the slave cylinder and the clutch cable but when i got it back i had another problem with it and i brought it back so they can fix it

As I was reading the beginning of this, I was going to share a story about how they scratched my car and then denied it, all without fixing my stalling problem that left me stranded in NJ on Christmas Eve 2001.
Also, if you park your car in gear, and its starts, it will only move about 6 inches, maximum (my experience), and it looks like there's scratches over a foot and half long on your front quarter panel!
Bay Ridge Nissan $uck$ a$$, and I'm putting it lightly. I only ever go to Kings Nissan (Coney Isl Ave) from now on.

BJGemini - the scratches go all the way to the back of the car.

Right now the ins co. are fighting it out. They say becasue it was left with them they are liable.

They are a bunch of a-holes there also. I never get work done by them. I may buy a part or so for maintenance from them and thats it.

I'm still under warranty, so I go there to save money. Otherwise I would go elsewhere, too. I was offered a "great deal" on AE Rims ther for $300 each. I didn't take it. I had one experience with Warnock Nissan in Morristown NJ that was phenomenal.

BTW if its damaged on their property and they have the keys, they are responsible.
(The dealership.)
Autostart on manual, still wouldn't cause something like that. not that far back.

They are seriously trying to screw you. First of all its in their hands so they are held responsable for the car you can call consumer affairs and they'll tell you the same thing. How F**kin stupid are they? they obviously were ****ing around and jacked up your car and are trying to make you pay for it.

jus to get it right, you have a 5 speed, but did the bypass so you could have the remote start? they got in the car and tried starting it like it was an auto, still in gear jearker forward and messed up your car?


any tech should know whene there moving any cars around, to see if the car is a auto or 5 speed, if 5 speed, check to see if your in neutral or in gear, put in neutral, clutch in and start it, its just common sense.

and whats with the scratch on the side????
that could not have happened from starting in gear. Once you get a investigator on the scene they should be able to tell that their story doesnt match up.

you may need a lawyer on this one, or atleast threatn with one at first and if they dont act right, then bring 'em out.

they are so shady. check and see if they have cameras in the service room.

also that dent on the side, if the blow came from the front it should have broken your headlights then went down the side of the car, since its just side only something else happened.

they claimed that they went to open the door with the alarm and there tech admitted to hitting the wrong button and that is how the car started.

lol, i bet if you get like a super high class lawyer you can getem for emotional disturbance... But my friend had the same problem with his MR2, one of the lines was all cracked up and leaked all the pressure,
