victim of road rage....

Ok so some crazed lunatic is in front of me and slams his brakes on hard - i have to do the same to stop - first time missed his car by inches the first time....
he does it again and so i pass him - but this second time he sticks his head out the window and curses at me and my roomate... so were past him - i put some distance on this jerk .... he catches up at a light and then runs out of his car and Chokes me.... ok now im wondering what the hell i did ... he says i ever cut him off again he'll kill me... ok so i say while he has his hand choking me " how can i cut you off i was behind you the whole time...
now he removes his hand and says " you do that again ******* and ill knock your ****in head off" ok so the light turns green i take off - get his plate # and call the cops - give them the same statement and .....

you better believe im pressin charges....

he held my throat forcefully to the point where it hurts when i swallow.....

now what do i do ???


it wasnt my fault this time really , i was in a mellow mood cuz i just got back from lookin at an m3 .. and this guy ruins my day ....

Thats somethin to press charges on. If you got plate #'s definetly do it. Here where i live, road rage is considered now a serious offense and can be charged as much as attempted murder in some cases. People have to realize that they have a problem... like a real temperment problem...

That's horrible,thats why I alway's have a fresh

can of mace and a good 3 inch knife on hand,so if someone tries to f*** with me they will be sorry they did.But definetly sew the bastard for all it's worth,go to a doctor emediately have your self checked out and make sure the doctor writes up what is a matter with you.Then you could yous that as evidence to sew the gerk,also you can complain about mentle injury say that your scared to drive your car now.Also if your under 18 and if he was over 18 he could be looking at jail time,and that would teach the bastard a thing ot two.Sorry to hear about it man hope your allright.

Get an attorney. Press all charges possible criminally. His attorney may offer you money to sign a release. Do not accept. Get a good civil attorney to represent you on contignency (you wont have to pay unless they collect). He will not only get a criminal conviction nearly without doubt (you have a witness -- does he?) but you may get some damages here. I am not one to be sue-happy but his behaviour is outrageous and he should pay damages for this.

already washed my car

ehh - already applied the meguires 2 days before ...

yeah i now have an aversion to the ford taurus which the guy was driving ... but i think everyone in there right mind has an aversion to that car... hehehehe


no joke though the guy was about as tall as me and his arm was 2 of my arms - **** actually lifted me off of my chair like a couple of cm's while i had my belt on

Hey Neel, sorry to hear about what happened. You have to do what you can to make this guy pay for what he did. Get some photos of your neck if it's not too late, so you'll have evidence later on. Glad to see you're doing fine.

Now I wonder what Doug has to say about East Coast road rage.

Hey, man, sorry to hear about that. I've seen some whackos around here, but no one ever got out of the car and went after somebody. Best advice (after the fact everybody's a genius, right?) I've got is to get away from those lunatics when you see them acting stoopid in the 1st place. Windows up and doors locked all the time, too. Can't trust anybody nowadays.

Take care of yourself. Hope you can get some justice out of it. There's too much crap like that going on...

Thats some crazy stuff. I have never heard of anything like that happening before. Glad that you are OK though. Press charges and he should get whats coming to him. Its good that you controlled yourself and didn't retaliate. That way he has no recourse.

im not down with that ... look for me to be gettin a Taser - night stick and Glock all within the coming months... either that or lots of

NRA stickers , i hear there good for 2 hp but they really help with the security

wow, that is some scary sh*t. Hope youre doin alright now, I know somethin like that would mess me up for awhile. Im constantly trying to avoid being a victim of roadrage. If I do **** somebody off and they dont accept my apology of a raised hand, then I do my best to stay as far away from em as possible. But if im at a light, and i see em approaching, i start looking for an escape route, incase they happen to step out their car. Ive thrice had to lose a people that were following me. Good luck with your charges on that freak!

so the car belongs to some corporation and this guy was driving it .. sheesh now i have to go through more **** !!

You should have hit him over his head with the CLUB.
That is just a typical day here in the mean streets of Miami. I have seen even worse things like that happening. thankfully I have always avoided them.

I just remember last week on my way home, I was waiting at the stoplight and all of the sudden I hear screeching tires. This lady who was jay-walking nearly got runned over by the lady who slammed on the breaks on the lane next to mine. The pedestrian walked up to the drivers' side of the car and punched her through the open window and then pulled her out of the car and continued to beat her. I couldn't believe my eyes.

I think you did the right thing, but you would not have been charged if you fought back. If you beat him after he retreated, yes. But if you were just defending yourself, you wouldn't be charged (at least not convicted.)

My friend carries a Glock 26 in his car. He says he is affraid of psychos like that.. I always thought he was crazy. But now after hearing this. Geez. I wonder what the guy would have done if he pulled that on my friend and my friend pulled out the gun. Hmmmm..

I have a great gun, a beautiful .380 semiautomatic handgun. I do not carry it with me because I think it could make a situation like this worse. I mean, the guy choked ya a little and went away. If I had my gun on me, and a guy choked me, I might pop him. While I would likely not have a legal issue, this would certainly complicate my life at a time when I don't need such complication.

I am trained in aikido and have been trained in a suite of other personal security techniques, so I'm very confident without my gun. Also, some ******* could potentially try for my gun and use it against me. He can't use ME against ME.

Man, that's crazy. I'm glad you are okay and it saddens me to hear that this occured at all. This is an assault case whether or not 'road rage' played a part. I don't think the legal system has defined this term yet but I do believe it was coined by the media to get people's attention. To echo many other replies, I say get a good lawyer and prosecute to the fullest extent of the law. Write down everything pertaining to the incident and keep records of all events related to it. Keep track of how you are feeling and how it has effected your life (ability to work, drive, go out, etc.). WRITE EVERYTHING DOWN, and keep chronological records...it could be years before it goes to trial. My wifes case is 4 years old now and still no settlment...but that's another story.

I think you guys should all can all the 'hunt him down and kick the guys ***' stuff or perhaps you didn't read the part about the guys arms being 2x normal size? Listen to what acitrano is saying. Even though it would have been self defense, you don't want to have to kill someone if you don't have to. Mace seems appropriate in this situation, IMO. You also don't want to have a gun in your car with you since you probably will use it or have it used on you.

I don't buy the whole mace reasoning -- even though it's much less than lethal (most violent criminals are recidivists and this would have no effect anyway) it is another thing that takes PRECIOUS SECONDS and can also be used against you.

What I *do* buy, in a situation like this (there are a million scenarios, but generally) is to react quickly and explosively, resisting but with an immediate eye toward escape. If you're in a car and someone approaches you, hit the gas (this is why we always leave room for escape when we're stopped at lights and signs, right class??? ) Agh.. I could go on and on but I'm sleepy... stay cool.

glad to hear you're doin all rite. as for the gun, i have one but don't carry it with me. reason being, in cali, you can only carry a gun in the trunk unloaded. check your local gun laws concerning transporting loaded/unloaded guns.
carrying a loaded gun, i believe, is a felony, that is unless you or your friend have a concealed weapon permit.

I had someone get out of their car once to come pound on me or something. All I did was take a right onto the road he was on, but he was driving way fast and rounding a bend and had to slam on his brakes -- in other words, not my fault because I was already turning before he came into view. He lays on the horn, flips me off, and I return the gesture. So at the next light he pulls up behind me (I'm at the line, several other cars pull up behind him) and he gets out and starts towards my car. Just as he gets to my window, the light changes, I tell him "f**k off and drive already" and take off, leaving him standing in the street with people honking their horns at him. He never caught back up to me.

Road Rage Solutions

Each state is different, but all are similar. In Tennessee, you could charge the offender with Assault for the choking incident, and felony assault with a motor vehicle, for the vehicle related action. Some states have road rage laws in effect. You would do this by appearing in front of a magistrate, or officer of the court, in the jurisdiction within which the offense occurred. This will be at no expense to you generally, unless you later drop charges, since most jurisdictions recognize the inherent importance of the ability of the common man to seek relief by the court. Since no law enforcement officer saw the offense occur, you will be the plantiff for the warrant. An alternative method would be to call your district attorney, and seek their advice on how to proceed specifically in your locality. He is in office to act on your behalf, since you pay taxes I presume, and the actions he recommends will likely be free of charge. You can also bring civil charges as well which will generally be treated separately, but an attorney at your own expenxe is usually necessary to follow this course. Never a bad idea to consult an attorney in either case, and no, I'm not one. Bear in mind that court time in either case will propably be necessary, so be prepared to bear this expense/inconvenience. Unfortunately this alone sometimes punishes the victim more than the offender. Good luck. This is serious business, but it's a serious crime.

Hey if he was driving a company car even better. Wouldn't thet mean that the company is responsible for the actions of an employee while on the job or COMPANY CAR. I doubt they don't keep records who drives what. I don't think a company just let's an employee take a car with out notification. If they say that they can't track that then just tell them that you'll go to the media and ask them to air the issue and chances are they'll come up with a name.
But talk to your lawyer first. don't screw up a good chance to get cash or mental help
In Houston almost all our news chanels have like a help the consumer section. Made be if you tell them you'll go to them they'll be more helpfull.

That guy must be nuts. Why would anyone approach a stranger's car?? Let alone choke someone. You have no idea what people carry in their car. ie. Mace, knife, 9mm, shotgun, AK47 or M16.

Man you and your room mate must have been trip'n. Is your room mate a girl? I can see a girl freak'n out. But I think, if I saw my friend being choked I'd get out and try to kick some a$$. But I know things happen quick and some times you can't react fast enough. later you're like dang I should've done this or that. And you get highly pissed.

I know cuz I almos got my A$$ whipped by 5 Big black dudes and 1 Big **** mexican dude. I'm mexican my self so I told the dude man you gotta talk smack cuz your up here in numbers. Well the dudes like twice my size and he said come on just you and me. Hmmm that's not the result I wanted either I thought to my self. Luckly they felt like sparing my life cuz I swore I was going to Hospital that day. But hey If I'm gonna get whipped I figure I better gets some swings in there.

The sad part about this is that it was about 1pm on Wed. and I was coming back from an interview so I looked all dorky in a tie. Man these fools must have been really bored.
I moved the next week fearing they'd come back and I'd open a can of whoop a$$ on all of them like Jet Lee.

get a doctors report

Since you said your neck/throat is hurting since he choked you so hard, make sure you go to a doctor to get it checked out, and get the report to use in court. If you don't do this, there is no record of any pain & suffering.

i just read your post man, i am sorry that happened to you. But hellz no would i let somebody choke me or even touch, i would've killed him , or just hurt him really bad(i am crazy from my Army Training). The nerve or some people.

Hey man, no lying, just last Saturday in Austin Tx (relatively quiet for serious crime) this 19 year old kid was cruising around and evidently not driving fast enough for some dude tailgating him. The next light, the dude pulls up next to him and shoots him in the head. The kid is dead. The 20 year old lunatic and some 15 year old with him are in jail for murder. This is TX (Thank God), so they'll both probably end with an IV and a trip to God to explain what the heck they were thinking. Be careful out there -- you never know what some whacko is going to do. Stay alert and, like many said, know your escape route at all times. Hope you can get this jerk that did this to you (and whoever he works for 'cause they're stupid enough to let him have a company car).
