Huge ticket, any experienced out there?

Huge ticket, any experienced out there?

This is my week, Goin to my school to pick something up down a very popular road I was simply rolling down a hill and a cop came over the crest of a hill in front of me (aka roller coaster type road) and the limit is 30mph, and everyone goes over because it's a steep downhill and 30 is impossible, so I was going like 40 and the cop immediately puts his lights on as he comes over the hill and I'm like k whatever I'll get a warning. He ended up sighting me for going 55 and 250$ I was like WTF and am pretty sure I can win this because of whats called "terrain error" basically on a cruiser rader it points straight, and can go over cars and such on hills ext. A week later I was out with two good friends, all innocent, bright kids, sober and we just feel like cruisin so we went on the highway a little then headed home, on a backroad which is pretty small and has a "rolling" terrain to it we decided to just pick up a little because there was no one around and USUALLY never is, and what do ya know headlights quickly come up over a crest and then we see blues, by then we were goin 50-70 (really not sure) the cop screamed at us ect. ect. (mind you these are the first times ive ever been pulled over, I have NEVER "pushed" my car in town, just my luck eh?) anyways, he said he clocked us at 70 in a 25 (its normally 40 but it was 25 in this one 1/4mile section because of a farm, and machinery activity i guess. So this ticket is 450$ and he said he let me off of driving to endanger which is obviously good but still I got this to deal with. I really have no defense for this and am planning on using a plea bargain, or taking a driving school type of thing, which in turn drops the charges, does anyone know anything about this? Thanks for your time and sorry for the length, I just thought it would be easier to invision with detail.

Just make sure you take plenty of lube when you go to court. Don't you have a website for the county you received the traffic citations in to give you information? I know that in my state you can take the driver improvement course to prevent points from being assessed on your license but you still have to pay the fine plus the cost of the course. Good luck and I hope you will slow down now.

Yes? then you're guilty. be an adult and face the fact you broke the law and you're going to have to pay out the **** for it.

2. call a lawyer. now. the money you spend on a laywer will come back to you many times over in lower fines and insurance rates.

don't ask why. just call a laywer.

matt93 is right, the lawyer fee might equal what the fines woulda been but the charges will get knocked down. think of your record.

I'm not sure what you want us to say, if you can pay $700 and get no points, that would be ideal. But I don't see how you didn't lose your license for 70 in a 25. Don't do that in NY State, because something very serious consequence-wise happens at 45 mph over.

I'm not sure what the others expect a lawyer to do for you except bend you over. I'll say this for the umpteenth time. If a person is facing criminal charges, you NEED a lawyer to either reduce the criminal charges or get the charges reduced to a violation. WTF does a person need a lawyer for when one is charged with a violation? But hey, I'm all for paying lawyers unnecessary fees! After all, we're I mean they're really good hand-holders.

to ask them what to do, not to hire one to fight for you... thats what you need a lawyer for, and wait... if you pay the fine, you dont get points?

Make no mistake, you WILL get some points. Just be happy you won't be ending up in jail. The fact that you had two violations so close together will NOT sit well with the judge...particularly with how fast you were going.

Just get a lawyer...show up to court looking as wholesome as humanly possible...good luck...

I guess you live around a lot of hills? I would go to court and talk with the prosecutor. If you're not happy with their terms, postpone and come back with a lawyer.

45-over gets points. always. If you are able to plead it down, you might get away without getting your license taken away for 6 months, but just take the points and suffer the consequences - it's the best you can do.

Get caught going 70 in a 25 zone here in Fairfax County, and the police will haul you off to jail on the spot, impound your car, and you WILL get a suspended license and $500+ fine.....Period.

70 in a 25, i don't know how MA does it, but in VA if you're caught doing that, you're doing time in jail w/ or w/o a lawyer. Not to sound too redundant, but if you value you're freedom, you really want to get a lawyer. be lucky he didn't charge you with reckless endangerment.

uh your a little bit late on telling him that he can go to jail, cause if you read the posts you would have seen that irish has already said that anything above 45 will put a person in jail if that person was driving in VA

my friend was clocked doing 100 in a 45. a lawyer got it down to 74 in a 45.

whoa.. gettin nailed doing 75 in a 25 will make you look like a REALLY BIG idiot in front of the judge. Its gonna be hard to plead that your just a kid who made a mistake once and learned from it, which is the only reason the judge may be lenient on you.

NH is worse than MA though.. so if you ever cross the border BE WARNED. got caught doing 98 in a 55. Got charged with Driving to Endanger, but lets just say it was later reduced to an 85 in a 55 and I got very lucky.

I am a lawyer. Although I dont do criminal law, I have successfully defended my own tickets. I dont agree with some of what I have read here and I agree with some. I would advise getting advice from a lawyer. However, you have to look at it from a business point of view. The cost to hire a lawyer may be more than money you save if you even win. First of all, just because you were speeding doesn't mean you are "guilty" in the strict sense. You have to be PROVEN guilty. Bymerely doing an act does not make one guilty. For example, if you kill someone, it doesnt make u guilty of murder - there may have been a legitimate reason ie self defense (this is just an example).

Second, if you go to lawyers for consultation, determine how much they will charge you and determine the odds of getting the sentence reduced. Factor in insurance costs and fines and all costs associated with paying the ticket, and determine whether it makes financial sense.

For example, I used to fight all my tickets. This was before I was a lawyer. Now, I have to factor in my time. If I bill at X dollars per hour, if it takes 4 hours of my time to fight a $120 ticket, I may just pay the ticket and accept the increase in insurance as I did my only ticket I have gotten in the last 11 years.

Are you sure it was because of the lawyer that the end result was less severe? That's great for the legal profession that you believe that. Keeps a lot of people billing hours, and a lot of folks who can't bill enough regular hours with side jobs.

dude plea bargain the points down and pay more and also be glad u dont live in nyc cause there is no plea bargaining allowed in nyc traffic court!

I've recieved 3 tickets in my driving career, which should have totaled 12 points in NJ if I pleaded guilty to all of them. Hired a lawyer for each one, and only recieved 4 points total. All of mine were speeding at 10-19mph over the limit, so it will be even more important for you to have someone professional represent you.

i got nailed on the jersey turnpike about 15 yrs ago, i was doing 125 in a 55 zone. the trooper made my passenger drive and took me to the courthouse where they asked for a 100 bond and issued my summons. when i went to court the judge nearly spit in my face and if it wasnt for my lawyer the prosecutor was trying to get me locked up. at the end i paid a 700 dollar ticket, 6 month suspension in the state of nj and 300 bucks to the lawyer and 6 points on my lic. if it wasnt for my lawyer i could have had my lic suspened for a yr or maybe lost my lic. lets just say i've learned my lesson,lol.

Given the proximity of the two tickets, I would suggest consulting a lawyer - usually they are able to reduce the severity of the offense.

rlwoo1 i said it changed to 25 because it became congested in that one area.. god forbit i had to get pulled over RIGHT there as apposed to the 40 mph zone. If I do win the first ticket, will the huge one look like my first to the judge?

If you're rolling with two guilty, stupid, drunk kids - that is when you have to go 30MPH. But I guess you're allowed to go faster with the innocent, bright, sober people in your car

How do you inadverently go 3x the speed limit even when you know what the limit is? Or did you hit the brakes and assume you got clocked @ 40mph?

About the NYS thing...it depends on what kind of representation you have. I had $800 and no points (spotless record) for what I did. So it depends on your representation.

He might not get points. If he gets a good lawyer that is. And I agree with the second part. I wore a dress shirt, slacks, and a tie with nice shoes to all nine of my court appearences (again, story below).

Anyway...my little story of a day in May 2004 when I was 16 returning from school...the following is an excerpt from a paper I wrote my senior year about the incident. I live in the boonies and the rode I was on was a similiar one to the one that the original poster was on. Hills, sharp turns...country. This is what happened:

And for those of you who were wondering what I was driving. It was a 92 Subaru Legacy GT Turbo. Here's a pic:



I got nailed with Reckless Driving (for going 120), Reckless Endangerment (for endangering my two passengers), speeding (for going 60 in a 45), speeding through a workzone (for doing 80+ in a workzone), and unsafe passing (for passing multiple cars in correctly). After everything was said and done, my lawyer was able to get the DA to give me a bargain of 3 years probation (1.5 if I'm good...should be off any day now) and no points or record. It's called YO Status - Youthful Offender Status. I couldn't tell what your age was, but if you are under 18 I believe...ask about it. But anyway...although I'm only 19. I grew up after that incident. I've been ticket free since May 2004. Sometimes it takes getting arrested and cuffed to learn such lessons. Slow down bro...it's not worth it. Good luck.
