Seat rocking issue not covered by GOLD warranty?

Seat rocking issue not covered by GOLD warranty?
Service dept told me seat frame isn't covered by my warranty, only within 36k miles... really?

Supposed to be bumper to bumper warranty up to 36,000 miles. Excluding things like brake pads and wipers.
