59 in a 45, or 55 in a 45? couldn't make up his mind

59 in a 45, or 55 in a 45? couldn't make up his mind

well.....my luck ran out. I got a speeding ticket today.

What I did not know, was that they have laser here in austin.

This is my first ticket, and I am 17. Luckily, I just finished paying off the car, and happen to have an extra couple hundred dollars laying around.

Also, on the ticket, under the "violation" section, he put "speeding 59/45"

then further down, he put 55 as the alleged speed. Would the court throw out the ticket for that? That would be nice, otherwise, I will take the defensive driving course and not speed for the next 12 months.

Also, I was completely not expecting this, I never saw the cop untill he was on my ***. He obviously had a good hiding spot. I was on the frontage road on ben white. I did not have enough warning to pull down the radar detector, which sucks, so he obviously saw it. And yes, I asked him for a warning.

You can try. I tried before because neither Estimated or Radar was checked off for how they told I was speeding and tried the saem thing. So I tried to fight it and they gave it to me anyway. I lucked out though cause my dad got it taken care of for me, but they might just not care and make you pay it.

I am prety sure I am just going to take defensive driving, and pay for it myself. i'm not sure if i'm going to tell them about it or not. If I don't have to go to court, I don't think my parents have to sign anything, or even if I do go to court, I don't think they have to show.

I have the $ to pay for the ticket and defensive driving course. I will be moving to colorado at the end of the summer, so I should be ok once move to another state.

I'm hearing less stories about people getting away with things these days. Seems like the courts have smartened up. SOmeone told me in CT he went to plead not guilty. So they said pay $80 instead of $160 or wait 1 year for a trial. Legit people don't wanna wait a year only to pay the full amount, which is probably what happens when you force the issue. Talk to the prosecutor if you go to court. At least you can save $$$$.

Loophole...

Laser you say? Can you spell L-U-C-K-Y!!!???

A few years back some guy was tagged using Laser, and had a lawyer for a neighbour. Long story short, lawyer ended up taking the case to the supreme court, and outlawed laser.

Now, being Canadian, I'm not sure how much of this is real, and how much urban legend, so I recommend doing a search on this matter, get the case law, read it, then if it is true, all you gotta do is show up to court on your day, and if the 55/59 thing doesn't work, present the case law. Bye-bye ticket!

If i remember correctly, i had informed you guys at the meet we had about cops lurking at exits numbered in the 230's and 220's and zapping drivers just getting off I-35 coz the limit changes from 70 to 45 and you just have the exit ramp to slow down. And Ben White falls in the 230's right??
well tough luck, but yeah, it sucks when they zap you on the service road...try contesting on the 59/55 deal...good luck with it

this wasn't anywhere near 35, this was way west of that. I rarely travel on 35, I hate that raod.

I'm just mad at myself though, because I was just crusing along, not realizing that I was going much over at all. I was prety much the only car around for a while. All signs should have pointed to "speed trap," but I guess I thought I was invincible (ya - right). GUess I gotta learn the hard way. But I was also not aware that the city of austin had laser guns.

Do state troopers have laser guns?

i didnt know that anyway i beat a ticket here once by putting it off for over a year and they actually gave up...

how did you go about doing that? sounds like an interesting option.....details please?

ya, i challenged it, then we ended up putting it off by getting continuances, i had a lawyer (a friend of my dads) who does many major cases so he was always in court on another case, and mine would be put off, then about a month or so agon when they went to do the roundup and arrest unpaid tickets they just gave up on mine, i dont know if they will do that with speeding... mine was very dumb: disregarding a barrier

Get on the Internet and try and find the traffic laws for your state. Most states have laws against speed traps. I know in GA that the police have to be clearly visible up to 500 feet away.

Still going to be hard to fight even if that is the law. Its just your word against his.

lots of stuff to read

i'm not fighting the ticket, not worth the trouble at the moment

mabe I will go to law school one of these days, and really learn how to fight a ticket....along with other stuff of course.
