My baby got hit today! =(

A girl driving a Lexus IS300 was backing out of her parking space at school today and she backed right into the side of my car as I was driving by. There were only a few scratches on her back bumper, but she put a nice dent in the side of my car with a bunch of scratches. Then she tried to tell the cop it was my fault. Anyways, here's some pics:

It doesn't look like much, but the damage came out to be $1500. I need to have the fender replaced, as well as the passenger door. Then they have to do all the paint work. Oh well...I guess I'll just get my body kit painted while I'm at the shop.

Later,

Yea, she tried to say that she was stopped and I hit her as I drove by. The cop was like, "so you're telling me that you were stopped and he hit you?" She was like "Yes." The cop was like "I disagree." Everything looks to be in my favor. She was definately at fault. I'll be on the phone with the insurance company tomorrow.

Ya dude, its your fault...I mean, you probably hit her at a certain angle, then manevuered your car magically out of the way so that you only got hit in that one spot, and magically, her bumper was hit in 1 spot as well...thats some skills!!

*end sarcasm*

sucks..hopefully everything will work out for ya.

Nick: Police know who's usually at fault when they look at the damage to both cars. You were hit behind the front wheelwell. The cop knows there is no way in hell that you could have hit her. If you had hit her, you would have had scratches drawn along your door. The picture clearly show that it was more of a direct hit.
The only accidents you would have to worry about is front end collisions and rear end collisions like the one that just happened that bish of a woman.

Sorry to hear about the trouble. but now its TIME TO GET THE WHOLE CAR repainted! Make sure that you find EVERY SINGLE scratch on the car and blame it on the IS300 ;-) This is your opportunity to get a REBUILDED max ;-)

This is a great point, Nick you really need to not let the insurance adjuster try and just get you away with the minimal fix. When I got in my first accident this summer it was only the rear fender but I had the body shop paint the back half of the car and the entire drivers side, pearl paint is a bish to match. When I got in my second accident I made sure they repainted the whole car because they didnt match the pearl this first time they did it and I wanted to take advantage of getting my stuff all at the same time. You just need to explain that you don't want mismatched paint, you want it done right the first time and a full respray is in order... find a really good body shop and they will agree, matching paint is hard and usually comes out like crap.

On a sidenote, you are lucky like i was, she missed your wheel by about 6 inches, think of the damage that would have caused. glad to hear you are okay and try to come out on top of this, don't let this opportunity slide by, I did and I regretted it the first time.

Well, I am getting the hood fixed also. It has a bunch of dings from a while ago. With that comes a whole front end repaint. I'm also having the body kit painted, so I'm gonna see about doing the whole car so it will match.

Well, I just got off the phone with insurance. They're going to come to the house to check out the damage. Once they get a copy of the police report, then they'll determine who was at fault and go from there. I'm not worried because I know it was her fault.

I didn't take the rental, only because my dad has a pick-up truck that he doesn't use because he has a state car. My sister also has a car that she doesn't use because she still has two months until she gets her license. Plus, I'm only 18 so I'm not allowed to drive it anyway.

I still have to swing by the shop and ask about the full paint job, but that's the route I want to go. Since 1/2 of my car is getting painted anyway, I might as well just do the whole thing.

What a W***E!!!
First she causes damage to your car and then she tries to blame it on you.
She must be out of her little mind to try to blame the accident on you.
Uh, usually when someone has a bumper damage and the other person has side damage the car with bumper damage would be moving, therefore causind the accident.
Unless your car moves sideways. ???
From the damage of the accident it looks like the adjuster might try to fix the door/fender rather then replacing them.
You can argue this by going to different bodyshops and getting estimates which will include full replacement of parts.
And remember when your car is in the shop you are entitled to a rental. So ASK for it. They won't just give it to you.
If her insurance is Allstate or Nationwide you're screwed they will try to put aftermarket or used parts on your car.
They should also provide a written lifetime warranty for repair because your Nissan Corrosion/Paint warranty just went out the window.

Good luck,
