A quandry about buying the 5spd parts

here is the situation:

I bought the 5spd conversion parts from a member of this board for $600 + $100 shipping.

Turns out it cost alot more to ship than he thought it would. We haven't discussed the new shipping prices, but I had expected to at least help out with it, as it was more than expected.

Anyway, I received the tranny, pedals, clutch lines, and shifter.

I did not receive the flywheel, axles, shift rods, or tranny mount.

I sent him 8-10 E-mails over 3 weeks asking what was up with them, and only got 1 answer a week and a half ago that said "What's your address? I lost it". I replied, and have heard nothing back since, and have been sending an E-Mail nearly every day asking for a status.

I then called and left a message with someone in his household asking them nicely to tell him to respond via phone or E-Mail....

Finally, since the 5spd install is coming up soon, I sent him an E-Mail a week ago saying that I would have to buy the parts somewhere else and take it out of what I owe him if I did not hear back soon.

I have since sent him several more E-Mails saying "look man, I REALLY don't want to do this - please respond by Wednesday (today)"

He still hasn't responded.

Should I just go buy the parts then? I've tried every way I know to get ahold of him, and I'm getting no response.

I always try to be 100% straight in any monetary deal, so I'm feeling a little guilty about doing this...

Any advice?

So you owe him money ? If so how much?

I can help you out on a few parts, or help you get them real cheap.

I owe him $350 technically.

But if I buy the rest of the parts elsewhere, I will only deduct the cost of those items from what I owe him - I won't take the $350.

So, just as an example, if the parts cost $150, I would send him $200.

I'm looking into parts now.

I'm mostly just asking if this is the right thing to do....

Sounds good to me. Especially if you gave him all those emails and you are about to start the swap. Go for it. If you need any parts I can help you find them.

Nah - I'm not going to post his name.

I don't think he's being like this intentionally, I just think he's being disorganized and/or slow. He mentioned a few weeks ago that a friend of his was killed in an accident, and maybe he's dealing with that.

But I just don't have any more time to wait for this, so I gotta do it.

If he had just sent me an E-Mail explaining things, I would probably be more leniant - but he's not even doing that.

You've emailed... you've called. It's been 3+ weeks...
You are well within your rights to get the remaining parts elsewhere especially with no firm date to send the rest of the parts. It is actually fortunate that you owe him some of the money. Unless he gave you a legitimate excuse as to why he didn't send all the parts, I think you've gone above and beyond what would be expected from a buyer.

Thanks - the person in question saw this thread and is trying very hard to take care of it.

He says he's shipping the parts tomorrow, which I told him I could deal with, assuming a tracking number is provided. As I suspected, he's simply been dealing with some personal issues.
