Need Advice on warranty issue or not...

I bought the my Max last year with 47K Kilometres and a few months later, i went back to the dealer for a chirping noise that I would get when the tranny would shift from 2nd to 3rd..it's duplicatable everytime...so the tech heard it and called up nissan Canada and they didnt know why this was happening but they asked the dealer to add a particular additive to rectify it. So they did that under warranty and the noise went away. But it's back now and when I went to the dealer yesterday, they told me they spoke to Nissan tech line again and they suggested they flush and add the tranny fluid once again...but this time, they want me to pay for it(even the additive)!!!! Is that fair though?
First of all, I have extended warranty and second of all they dont even know what the hell the problem is!! SO why should i spend 250 for a damn tranny flush and the stupid additive.
I've even called up Nissan Canada and they said it's a maintenance thing and so i would have to pay for that and it's not warranty.
I have 61,000KM on the car currently...
Any advice?

If you read your service receipt the work that nissan does it warranted for 1 year. If the same problem occurs within that time frame they will fix it and shouldn't charge you. You might just have to give nissan america ( or canada in your case) a call about this see if they would push the issue for you.
