I orignally bought these tails on June 27th for $90 shipped

I received them on July 5th. The tails arrived broken though.

I contacted the seller with the problem and provided pics and asked how he wanted to handle it.

I have got the run around since and now he has stopped communicating with me.

So i'm giving him one last chance to rectify the situation before i make a paypal claim. I only have 45 days to make a claim and thats almost up.

Heres the communications we had.

I'll take the tails for $90 shipped. You can buy them brand new for $110

I am SO pissed off right now.. words can not measure how much I want to choke someone out. Sorry.. ****** UPS sucks *****, I'm just through the roof right now. I am attempting to put a claim in with them on the lights, gotta go through the office at my workplace on it. I hadn't been on the .org in almost a week, and yesterday I got your message, I was so pissed I had to get off the .org and vent. I've had a rediculous past 5 days and this was like the killer icing. As soon as I know something further, I'll let you know whats going down.. sorry to keep you waiting bro.

I'm having a ***** of a time getting this ball rolling because I shipped them out through my work.. so now putting a claim through UPS seems to be equivelent to pulling teeth! I'm gonna give it another day or so, and if no go then I will have to move onto plan B. Will be in touch in the next day or two..

Yeah.. apparently there is nothing I can do about it because it was shipped through my businesses account.. so I'm not sure of the best way to handle it, but have considered shipping you a brick and then placing a claim against that tracking number, cuz I dont think I should take it in the *** cuz they played foosball with the tails.. what do you think?

I basically told him i wouldn't accept fraud and that i have had packages arrive broken that i had to refund the people on.Thats life. So i told him i would expect a refund since i didn't get what i had paid for. Since i sent that message i have received no response even though he has been online.

In his defense, UPS sucks at handling damage claims...


I have one with them from eight months ago that has not been resolved yet. They literally take forever to get anything done.

I know getting any insurance thru shipping companys is hard and almost useless. He already told me ups would do nothing for him. So it would be up to him to do something about it.

I can speak from experience re: the best way to handle a UPS claim. If they deny the claim initially (as they very well may), file an appeal. Usually (when you have a leg to stand on, that is), the "appeals representative" will approve the claim just to move on to the next one. I can't stress enough that you have to be able to prove to them that the contents were packaged properly. Another option (assuming you paid via Paypal from your credit card) is to call your card company and get a "charge-back" in motion. Good luck.

I met DJ several times in person and he didnt strike me as the type to try and stick it up anyones ***. He usually provides any parts the guys here in the New England area need.

They were not packaged properly in my eyes. Since i do alot of sales online my paypal account had a balance so thats the only way i could have paid unless i would have withdrawn it all. So i'm stuck with broken tails

obviously UPS is responsible for that, but rather than work with me you want me to eat $100 which I am not willing to do. had it been MY fault, it would have been another story.. anyways, what does THAT have to do with these coils??



I told him i would expect a refund and that is the last i heard of him until now. He never offered any other resolution so i don't see how he thinks i would not work with him.

I have sold on here as well as NYCMaximas, without incident. Never any complaints, only praise. I have also sold in person locally, and extensively on eBay with well over 150+ positive feedbacks. I am not in the business of screwing anyone!
I paid more for these tails then I let them go to you for. CE sells them for way more also. I already took a hit on them. I was pissed to find out that they arrived damaged, and I honestly did everything in my power to get UPS to reimburse for what their poor package-handling caused. The pics clearly showed these lights and they were not broken. I packaged them plenty well, not my first time shipping breakables. As a last ditch effort, I even considered what you call 'fraud' and I consider slightly shady rightful retribution against a company that can more than afford to pay for their mistakes, but you would have no part of it.. instead you continued to badger me, after I told you I had no intention on taking all of the hit. THAT is why I stopped contact with you.
On another note, I sold you a full set of tails a while back, when I first came into the Maxima game.. (95-96 stock tails) You made me list them on eBay buy it now instead of on the .org, remember? Those arrived perfectly. Just wanted to mention that, so you recall its not my first time shipping tails. UPS just wasnt in the mood to play soccer that day I guess..
Paypal sided with me within 24 hours because they realized it was a shipping company issue, as well.. they dont hold sellers responsible for shipping damages!

What you paid for them and what you sold them for is a mute point.I didn't realize it was you who i bought tails from over a year ago but now that you mentioned it i do.

You keep stating to me that your not going to take a hit on these. Do you feel i should? You still have offered no resolution So what is a resolution to this?

I have to say that i I know DJ and he is most definitely not the type to screw anybody, i have bought parts from him locally and i always got what i payed for, in fanaticrockford's favor I understand why you would be upset, but in i have to say he tried to resolve the issue. If you buy breakables and have them shipped its a good idea to ask the seller to provide shipping insurance! and i am sure that DJ would have been more than happy to provide that service for you. Just like in an ebay auction if you do not purchase shipping insurance its on you not the seller.

How has he tried to resolve the issue? He shipped them thru his work so couldn't make a claim. UPS shipments are automatically insured for $100.
I also have to disagree. I believe it's on the seller if problems arise. Maybe thats just me. I sell alot of stuff and if something happens i make sure the buyer is satisfied regardless if it's my fault or a shipping carriers.I believe they should get what they payed for.

I stand corrected you are right about the up to $100.

he wanted to ship a package and put a claim up against that one, you refused? i know you might see that as fraud, but it happens, he shipped it ups they broke it, why not go the way he sugested, ups broke them why not have ups pay for them???

I don't understand how you think having ups pay for something that they broke......fraud, i hate to say it but in the shipping and handling world, that happens all the time.

eaither way this is not my battle, dj's a good seller, i am sure you are as well, hope you 2 can resolve the issue, and i see nothing wrong with handling it the Way DJ suggested.

Some times you gotta take the hit. Believe me your reputation is worth more. I sold my BBK to a guy and the box was torn and parts were lost by USPS. I didn't have to give him any money or do anything for him because he didn't offer to pay for shipping insurance and as you know paypal only cares that you ship the item not if the item is damaged or lost.
None the less i refunded him $100 so he can replaced what was damaged and lost yeah it sucks i am out $100 but you know what my reputation is in tact and i did the right thing. What goes around comes around man . I don't think people will want to deal with you now. No offense to anyone just sharing my 2cents. check my feedback and talk to Mxrider52 he can share details with you.

I have been in a similar situation. I also ship all my stuff at work, and I have problems with UPS loosing a wheel. So I filed a claim with them for the price of the wheel and tire. They only refunded me the $100 since I did not insure them for anymore, plus the freight charges. My point is, that you can still file a claim even if you do ship thru your work. Just talk to accounting (whoever gets checks) and let them know whats going on. UPS sent a check to my company who in turn wrote me a check for that amount and then I sent it to the buyer. It did take a while to get everything worked out but I was at least able to get $100 back to the buyer. Good luck.

I will contact UPS again and file a complaint, and see if there's anything I can do. Perhaps the persistence, if nothing else, will make them cooperate enough to refund me. fanatic, I will let you know if I make any progress. However, I apologize if this comes off as ****ty or reputation diminishing, but if I am not reimbursed, I do not plan to refund. It sucks that it happened and I would be pissed too, but I did ship them in PERFECT condition, and was already lowballed on what I wanted for them anyways. What UPS did with them from there I am not responsible for. I am not going to take the hit just because you said you would.. but you are right UPS IS supposed to insure for $100 automatic, so if I have to I will speak to a supervisor and see what I can get done..

Joe is a good guy, i just bought a couple of things from him and it went down pretty nicely. DJ, you are handling this like a man with your last response and I think Joe is thankful. You guys should not try to make each other look bad, because in the end there will be friction among a lot of orgers and that's the last thing we want. We are a comunity that share the same interests and should work together instead of against each other. IMO, you are both right...try to meet in the middle if someone has to lose. Good Luck
