MY MAX NO!!!!!!! dumb woman - wreck

Well my g/f was in her 06 Max and was being curteous for an 18 wheeler that was merging onto the highway (hwy 280) and the car in front was tring to get over as well so she signaled for them to get over. Wouldn't you know it the d*** person moves over half way and slams on their brakes-well she slams on hers (remind you she has a 17mth old in the backseat) and happens to pit maneuver the car so she the max has a dented fender, scratched headlight and tons of scratches and paint trade on the front bumper.

She told the cop what I wrote above and the woman in the other car told the cop she didn't recall even moving over. you can't remember if you moved over-what a DA. So now for the first time I have ever heard of it she has to go to court at 8:00 in the morning. I have no clue why I guess so the cop can let a judge hear the sides to pick who is at fault.

AND now you wonder why there are no courteous drivers anymore, because of DAs like this person.

As long as the baby did not get hurt. The car can be fixed and yes there are DA's out there.

im sure when the judge hears the other person say they don't remember, and your girlfriend give a detailed re-enactment it should go her way. if you have "amnesia" for somethign that recent you shouldnt be able to drive.

Some drivers should just give up driving completely. Glad all is well with your family.

Dues? We could use some "lawyerism" in this thread!

I'm really happy the child is OK. That's scary.

Sorry to hear about that, but aslong as your child is fine thats all that matters.

Theres alot of DA's out there, I hate the one that takes forever to merge...they stay riding the white line until their about to get crushed by an 18 wheeler.

If your gf was in her lane and the other lady was merging into your gf's lane, your gf has the right of way. But then again, because the damage was your your front and the other lady's back, the judge might say that it's your gf's fault for not leaving enough room.

Similar thing happened to my wife here in MA....and the insurance company deemed it my wife's fault. (My wife was driving straight, a van was merging into her lane, wife honks cuz he's about to hit her, he swerves back into his lane, but then immediately comes back into my wife's lane and his rear quarter panel contacts my wife's front quarter panel.) Sucked.

well on the upside if you do win and need a new front bumper you can get the gtr or redline front end. and the headlights are about 500 dollars a piece. You can buy two on ebay shipped with HID if you don't already have them. stuff like this can have long term effects on people. You wife might be more paranoid driving and depending on the seriousness you son may be afraid of driving too. Hope all works out.
