i saw that the other day, its not imitating cause they are just using the pics as examples.. but they could get in trouble for not having permision to use his pic without consent.

but if you put your picture on the internet and have to indication you don't want people copying it he can't get in to trouble.

All pictures are assumed copyrighted. whether it's illegal or not, it's VERY bad taste to steal someone's pictures- especially if you're going to use them on ebay to make money using them.

This has nothing to do with the auction, but are those fenders on the white one custom or a bolt on thing?? I kinda like em'... I think... ?

well.... if you post something on the internet you have to be ready for people to take it. unless you do that copy protection like on some sites.

Actually, you are wrong on the copywrite issue. Anything in print or photo, be it hard copy or on the net, is protected in the U.S. under copywrite protection code. Technically, it is agianst the law for him to use those pictures for anything other than private use without premission, especially in this case where he is attempting to use them to make a profit from what he is selling. It is a common mistake, and sometimes the laws can be confusing (what's personal use and what's not), but in this case he is clearly in violation.

Yep, pictures are actually considered copyrighted at the time they are taken, not when they are developed. So the moment that the photographer took the picture, it's considered a part of his property and he holds all rights to it.

At least this guy isn't trying to sell a car and claim the pic of dnas's car was his. I remember that poser that was trying to sell his car, but it was actually Craig Brace's.

We have some friggin' crooked people running arounf this world, you know?

i understand that, i'm just saying it's going to copied unless you put one of those copy protectors on it somehow where it won't even let you right click on it.

He could still be sued though. It's automatically copyrighted. If DNAS wanted to, he could maybe make a little money off this. I don't think it's worth it, though

i doubt he could sue... because if thats the only time the guy used the picture and he made 10 dollars then he doesn't have the right to sue does he? A civil suit has to be for more than 20 dollars.

plus the cost of a lawyer (if one is needed..i dunno) plus the actual time to do it..definately not worth it.

I think the bigger issue is that it isn't right, not whether or not he could sue. That's kinda rediculous for just a little eBay auction. It's more aobut the principles... I just wanted to clear up the issue of the legalities. Like Matt said, the pic is copywrited from the moment it is taken, even digitally.
