Finally after 3 months of pain she back!
I pick up my max today and put 150 miles on it. The new tranny sounds nice or makes no sounds in other words. The limited slip felt more responsive in the dirt. I am still mad at the mechanic because of him denying puting a dent in the hood and grill and denting the rear bumper. Then when I left to go to the police station my max shut down! I open the hood to findout that the CAI was not connected! I put the complient down on paper at the police station and had a officer look at the dents. I also went to get a estimate on the damage and the guy will get back to me tomorrow when he calls on a new grill, hood and rear bumper! I also will be visiting the DMV then a Lawyer tomorrow! I gave up on battle for the warrenty but won't let him screw me over on this damage

OK I just went out side and I smelled gear fluid and thought noway its my max but I said what the hell and looked under to see a pile of fluid under the tranny and its dripping out fast

Why are some people all about sueing
Don't get me wrong there is a time and place for taking proper legal action, in my opinion this isn't the time or case. Whenever your vehicle is repaired by a shop and something goes wrong you have to give that shop a chance to correct the problem. Now if you keep bringing it back constantly for the same problem, that's different but even then "I" don't think it involes legal action "unless" the shop refuses to refund your money. When I had my tranny rebuild within a couple of days I also notice AFT leaking. I was upset, but being a mechanic I understand that things can happen. So I drove the car back and told them about the leak, the owner personally got into his car (a bad a-s-s Caddy Escallade) with his greasy work boots and cloth and drove me home. The next day I pick up the car and the problem was corrected. The harness for the solenoids wasn't completely pushed thru the casing in-order for the o-ring to seal it properly. Problem solved, case done and 11,000 miles later I'm still a happy camper. Basically give the shop a chance to correct the problem, I understand for some being without their car can cause problem with there daily routine maybe you can use that as a arguement for them to pay for a rental car. I bet one of the cv joints were not pushed all the way in. I did this when I did some cv work. Or maybe he damaged one of the shaft's output seals.
Could be alot of reasons for the leak.
In this case for the body damage, I would inlist the advice of a lawyer.

Firstly, Let me say that Im sorry that you're having so many problems. The best anyone can give you would be to report them to the BBB (Better Business Bureau). The BBB is slow in handling problems, but you get good responses from them. I've personally contacted them with a problem and sure enough, problem solved.
Take pictures of all the leaking, dents, everything. Have another mechanic look at the transmission to see why it's leaking and approximately how much it will cost. It could be something as simple as the hoses that go into the radiator weren't tightened enough. These people sound like real bastards, make them pay. As soon as the smell a law suit comming, they'll be singing a different tune. This sounds like something for small claims court though.
Do everything you plan on doing, but make sure you contact the BBB also, it's completely free.

Damn man.. you've had more nightmares with that shop than I would have ever let them give me! it's time to sick the lawyers on them and have them refund 100% of your money PLUS pay for the damages..
if you even bought another tranny and had them install it, it shouldn't leak... if it does, then those guys obviously don't have a clue what they're doing and should be dragged out into the street and run over by the flatbed truck you had to tow your car with.
