Stick popping out of gear (sort of)

I've noticed occasionally when I shift, the stick will sort of throw itself out of gear when I push the clutch. I've never actually seen this happen because I'm usually pulling it down, but it feels like it's pushing it out of gear. It only happens once in 20 shifts, but is annoying. It seems like some kind of mechanical hang-up, not just a "sticky gearbox", but I could be wrong. I can here a clunk like sound when this happens. Happens most often when the gearbox is cold, but has happened when warmed up also. Everything in the transmission is stock right now including the transaxle oil. I tired searching, but didn't know what to search for. Anyone hear of anything like this before? Is it possible switching to synthetic transaxle fluid would help? I'm still under powertrain warranty, but don't feel like taking all my aftermarket stuff off incase it is something big and they try to weasel their way out of it because I have a CAI or something.

what gear?

i can do 2nd to 3rd shifts without the clutch.. so technically if my hand was on the shifter it would pop out..

i know the old sentra SE-R (91 - 93) use to pop out of 5th Gear on the highway.. but i never heard of this in a maxima

Guess I should add that this happens only in the "top" gears, 1, 3, maybe 5. Never happens coming out of 2nd or 4th.

I tired a couple of variations, but didn't find anything like what I'm experiencing.

The only lead I could find is maybe the linkage is out of adjustment.

I'm also wondering if since shifting has become second nature, I'm pulling the shifter down from first before I have the clutch fully depressed. Can't seem to reproduce the problem though.
