Off hand, if he wasn't wearing a seatbelt, that would pretty much negate any lawsuit. Even if you didn't say anything, one would question him wearing one. As the damage doesn't correlate to his injuries if he was wearing one. My old car had 2x that damage and I wasn't injured at all. Then again, I was wearing my seatbelt.

Well put and my point precisely! As I mentioned before, sometimes injuries surface down the road. My sister was in an accident about two months ago and is now sufferering from post-traumatic syndrome, which has only recently surfaced. She also suffered a mild brain injury (without hitting the windshied or steering wheel), nerve damage in her neck and it may be 2 to 3 years before she sees any insurance settlement.

That's why I said to be silent about the seat belt if its not already in an accident report or police report. You can suffer whiplash even with a seatbelt on.

Typically the first reaction once you're in an accident, and have shaken off the cobwebs, is to check on your fellow passengers. I don't believe there were any in this case. Then typically the focus becomes on the vehicle if you know you're capable of getting out of the car. At this time you have to unbuckle your seat belt, which of course you had done up!

Don't sign anything including an accident report before talking to a lawyer.

glad your ok man....the whole process with take alot of time but if done correctly you will end up making out on it. I love how SOME people on this forum make arguments out of something that should be taken seriously..come one now!

uh, not that accidents are a good way to make some pocket change... just kidding. sometiems you can walk away being ahead of where you started. but wow, sounds like quite a hit and incredible that you're outta the hospital already! what was the reason the person in the explorer gave? were they incredibly sorry, or just like "oops, hehe, guess i thought i could stop. how bout that...?"

I don't think anyone wants to argue with you...........the damage just doesn't look like a truck hit it @ 70mph. I had a friend who got hit from behind @ 45mph & his car was about 3 ft shorter afterwards.


Glad to hear you're OK. Do log EVERYTHING that happens from here on out. Don't settle on anything yet. It's awkward that you know the person that hit you but if you've got bodily damage (to yourself) you best wait awhile to see if you get anything chronic. Seriously. You may have some serious medical bills headed your way &, friend or not, the other persons insurance co. should be footing the bills, not you. You didn't ask to get hit.

sorry to hear you got hit by a girl .....
yeah man at 70 mph, you should have you rear bumper where your rear seats start.
some suggestions:
-dont settle anything w/ insurance company yet
-talk to a lawyer (there's some $$$ to be made since she facced ur car, that way u can get a tite car)

Sorry to hear about your accident. You clearly were not hit at 75 mph though, or else the front and rear of your car would be one, and you would have been thrown right through your windshield and probably would have died. From the looks of it, I would say you were hit at no more than 10mph.

Really guys. He expressed not wanting to be a part of the org anymore because of crappy comments like this. Why can't you just be helpful? Why do you have to belittle and question his integrity?

The guy got hurt and he lost his car. Have a little sympathy. Jeez. Who cares if it was 75 or 35?

Good luck man. And don't sell your aftermarkets off for nothing just yet. 4th gen maximas are easy to find and pretty cheap to buy. You won't get better bang for your buck in terms of performance, especially since you've already got the mods. Later.

I will say this, I've been in 6 different wrecks, a couple totaled cars in that mix. From your injuries I will give you a suggestion:

It may take that long to really know what is physically messed up, get a lawyer. I still have slight nerve damage to my right arm from slamming it into the dashboard. I still get nerve pain in my leg from another accident. I have to work out or my back gets messed up. Those two accidents were in '95 and '97.
Don't take this lightly, I couldn't even try to join the military to become a pilot because as a result of one my accidents I have two sligthly bulging discs in my back.

The reason this thread is weird is because it really doesn't look like you were hit at 70, or 60, maybe 40 or less (if you didn't have the brake on). You can still get seriously hurt getting hit at 25-30mph.

The fact is, it doesn't matter, make sure you do what you can to recover. Remember her insurance company is not looking after your best interests.
I've stated this before in another thread but our family's policy got cancelled after one wreck, we then sued our own insurance company for the uninsured motorist policy, we got a good chunk.
Even if you do get paid, most of the time, YOU WOULD PREFER NEVER TO HAVE GOTTEN HIT IN THE FIRST PLACE, IT ISN'T FUN.

to be honest your never really ahead hence why insurance is so high so get what ever you can out of it. I have no mercy for insurance companys sence they have no mercy for others. As for youI am sad to see a max like that and just hope your alright . I would def make a claim hell your out of a one car def need to be compensated. I dont care if the girl is carmen electra make a claim it aint going against her its all through insurance.
