Shift Lock/Brake Light Problem

I've been having trouble shifting my car after I start it up (From P to D). When this happens my brake lights do not function and I'm not able to put it into drive.

My quick fix is to turn the key once and put the car into neutral and start the car. This works but I lose the function of my brake lights.

Does anybody know how to fix this problem? It almost seems like there is an electrical issue.

One other thing. It seems to work at random sometimes. But lately it's been not working more often.

Replace the brake switch (lower, upper is for cruise cancel).

I don't have a problem with brake lights , but when I can't shift it to D I press on brake pedal couple of times, and if it doesn't help I turn the steering wheel a little bit, and if all these didn't help I just push my car a little (when it's in P) and the shifter works.
