ad picture

cardomain.com/sounddomain.com is using my car in the ad. i think it's kinda cool that my ride is on the ad, but am i entitled to some compensation???

Did you give them permission to use your picture? If not, then you are definitely entitled for compensation. I hate it when people use your pictures to make money for themselves. Went through this last year.

Definitely? No. Morally they *should* compensate you and if I were you I'd go after them to try to get something, but unless you KNOW it's your car they don't have to give you anything.

Did they ask for pictures? Did they tell you in writing "hey, look, we used your picture"? Maybe they're using a car that has the same mods as your car and they took pictures at the same angles. I doubt they went to the trouble of "recreating" your car (it does look nice, btw, so can see why they used it) but you knowing it's yours and proving it are completely different. I guess it depends on how hard and (and they) want to fight for it.

or perhaps by having an account with sounddomain, when you agreed to having the account, some of that small print said that anything you upload to their server automatically becomes their property as well and therefore they can legally use it w/out compensation.
then again, they could always charge us for letting us use their servers.

i think somewhere in the agreement, they're allowed to use the pictures cause it's on their server when it was uploaded.

wow, I never thought of that so I looked... this is in the "terms and conditions" you agree to if you become a member:

"CarDomain Networks has unlimited license to materials submitted to any web site it owns and operates."

So again, morally they SHOULD compensate you, but unless you can prove the agreement is illegal (it might be in your state) then legally they can use your picture because by agreeing and uploading, the picture became theirs.

Their server means their pictures. They should have at least contacted you though.....

you cna't prove that an agreement is illegal. it's simply an agreement, you may feel it's unfair, in which case you just don't agree to it, aka don't become a memeber, but if you join, then you've agreed to it, which means you can't prove it's wrong.

Agreements can be illegal. It's a kind of contract. If you're willing to do some research you might just find out that an agreement like that might not be legal in your state. It happens all the time... a company makes a blanket statement that later turns out to be against the consumer protection laws in some states. I doubt a picture of a car is worth it, but ... if the consumer protection laws forbid an agreement like that then even if you agree to it they'd still have to "make it right" because they proposed an illegal agreement.

In the meantime it looks like it's time to watermark all the pictures uploaded to anyone else's webserver. I bet the wouldn't have used it if it had your name plastered on it in a place that they couldn't easily crop.

I allowed Grille-tech to use my car's pics in their ad's , but the ASKED first.. Im not sure why Cardomain wouldn't do the same ??
