GUYS! I got screwed, what can I do?1?!?

The day I bought my car, I asked the dealership for a CARFAX report, I told them I wanted to be sure that I wasn't getting a rental car.
When I asked that, the guys told me they already have, and its clean.

Well, tonight, I decided to look for myself, it was a ****ing rental car! Not for too many miles, but thats beside the point...

Has anyone EVER ran into a problem like this? What should I do?
Please let me know, I'm giving them a visit first thing in the morning....

I'd threaten to bring in the lawyers or the Attorney General's office if they didn't give you a new car. Or, if you are happy with your car, at least the Nissan Extended warranty and a few accessories on the house.

Sorry to hear that you were "conned" by the dealer... I know you were excited to buy the car but it's your fault that you didn't check the carfax before purchase. I don't mean to rub it in your face but buying a car should be a careful and patient process... Dealer is legally obligated to disclose if the car has ever been salvaged, other than that, they don't have to reveal if the car has been a rental. (I could be wrong, check with your state law).

Don't worry too much tho', it's a Max. They are built to last... even if users abused it, it's still ready to take your abuse!

you can go back to the dealer and complain... it's almost impossible to ask them to take it back (unless you legally threaten them) but you may be able to pinch them to provide 3 years extended warranty for FREE or at a reasonable price. Don't forget that dealers sometimes get 50% commission on extended warranties so it's highly negotiable... plus they LIED to you so you can b*tch about it and get it for a low price.

Also, if you are too worried about your puchase, you can buy extended warranty just for peace of mind. If you plan on buying extended warranty, here's something for ya...

I wouldn't really want to sue them if I had the chance (it always gets you in the long run, hehe)
But like you guys said, the max can take the beating, and hopefully something good will come out of it

How's it his fault? A dealer has a moral and most of the time legal responsibility to disclose the history of a vehicle, if they openly lie about it to make a sale they are violating laws in one way or another. Purposely misleading a consumer is a crime in every state that I know of.

But like I said, you should really threaten them to get freebies... don't give up easily. Dealers are the worst kind of people. They will lie, they have no code of ethics. If I were you I would threaten them hard!

Try calling the Nissan Co. I'm sure you can file a complant and I did when my dealership forced me into some b.s. VIP membership for 1,400. Nissan then contacted the dealer who still didn't give us teh 1,400 back.

go to hertz.com and find a max just like yours and print out the page which will include equipment, mileage and price. Insist that your dealer match the hertz.com deal. Hertz has thousands of '02 and '03 SEs for sale, all with <25,000 miles for $16,000 --> $19,000.

My 2000 Maxima SE is x-rental too, or been on a lease, dont quite remember exactly. I bought it off at a dealer auction. It had 36000 miles on it when i bought it. Fully loaded. Its in a very good condition: interior, exterior, engine.. everything. Except the rear bumper had some deep scratches, but in a month or so I got hit in the rear, so the body shop got me a new rear bumber Anyway, x-rental car in excellent condition and for cheap, so I am pretty satisfied.

how many miles are on the car?see if you can get warranty history at dealer. did the car have 2 new front tires?was it ever hit? then don't worry..........they are great cars that last!

when I was looking for a used car last year, I ran into this...dealers would not tell you the actual history of the car...even by law, they have ways of not giving you the exact answer...thats why there is Carfax...I was fortunate to have a friend who had access to unlimited searches at the time I was looking....6 out of the 9 used cars in dealerships that I looked into were ex-rentals..the dealership would not utter the word 'rental' if you asked them...they would say it is a "fleet car" or "lease return"...both terms can translate to the car/s being a part of a fleet of cars that Hertz or Avis leased from them...so legally, they gave you the right answer...you just have to read between the lines and do your due diligence...on the other hand, if the car is in good condition, no rattles, runs good, etc., be happy with it...I ended up buying a car from Enterprise...still going strong...just change the engine oil and tranny oil on a frequent basis and your max will last a long time...

In the eyes of the law it IS his fault. He took their word about the carfax and now is paying the price. If it gets to court it's going to be their word against his. Who would a judge believe? Give you a hint, the dealer. Know why? Because he signed the paper saying he's buying the car, that's why. It's he-said/she-said and there's no way to prove anything.

Having said that, mad_maxx03, try to get an extended warranty out of them. There is NO WAY you'll get a car so aim for something reasonable. The dealership manager may give you an extended warranty to try to console you. DO NOT go in saying "I'll never buy another nissan" because they'll kiss off your business and not even try to make you happy. Instead go at them with "what are you going to do to keep my business?" and see if they'll start giving you stuff.

I nearly bought a 2002 from a dealership,
they told me that it wasn't a rental and he even gave me some BS story that he knew they guy who they got the car from and that the guy traded it in.
I checked efax just before I bought it and found out it was a rental.
I hate people who lie!

when working with a dealer, get EVERYTHING IN WRITING, no matter how small.

When I bought a motorcycle, they promised free deilivery to my house. I thought that was good enough, but my wife insisted they write that on the contract and they did. Wouldn't ya know it, they tried to get $50 out of me the day it was to be deilvered. It sure was nice to be able to pull the contract out. :-)

If you didn't get this in writing, you prolly aint got a leg to stand on unless they are honest. If they were honest to begin with, they wouldn't have lied about the rental part (or that they actually pulled a carfax report) in the first place.

I know how I drive rentals. I wouldn't want one.

I worked in the car rental industry for many years and there is no way in hell I would ever buy a previous rental. Those cars get used and abused to hell and back. Most of them go through auction sales, many have been in accidents and repaired, sometimes poorly.

I see that on the window sticker and I won't even consider the car.

YMMV.

Check the laws in your state. If the law states that a dealership must disclose if the vehicle was a previous rental then it would have to be disclosed on the paperwork you signed. If it is and you missed it, there really isn't much you can do about it other than make a fuss and see where that gets you. I guess if you go to Nissan corporate and tell them you were lied to and complain to the BBB you might get somewhere.

I have learned rule of thumb....never trust the dealership or any sales person. I purchased my car from a non-Nissan dealership who told all sorts of lies. I did my own CarFax and seen nothing wrong but over time, day by day I would notice something new (paint and overspray).

I found the previous owners information still in the car and I called her. She and her mother told me that the car had been in an accident (rear-ended) and that it was repo'd from her for none payment after having the car for only four or five months.

Long story short, I have threatened them for lying and am currently trying to sue them. Do the CarFax before you buy and look that car over like it owned you money.

I hope things work out for you buddy. I know how you are feeling. MAke them give you something (i.e. extended warrantees, free details, free oil changes, free inspections...)
