Trans Help!!!

Okay, heres the problem. I had at 15k miles my trans replaced because it was slipping from 1st to 2nd, my dealers choice. Now with the new trans it slips 2nd to 3rd and sometimes slips out of gear and redlines then drops back into gear. The problem doesn't happen all the time and has no pattern or common times that it does it. I've taken it to two dealers and nobody can figure it out, Nissan is stumped, shocker I know, what to do I do? Can anyone help, one dealer thought maybe the TCM, but Nissan won't fix until he/she views the problem. I told the dealer not to replace the trans as it isn't a mechanical problem but electrical, they did anyway and still a problem, please please please help. Chris

you might have this option:
check your state "lemon" laws. i bought a 2k1 Mitsu Montero Sport in 2k1 and our NC lemon law says that if a dealership can not fix a problem in 5 repair attempts then it is a lemon. the manufactor will then have to buy the vehicle back from you.

i have a tranny problem and after 5 repair attempts they could still not figure it out. they gave me the same "we have to see the problem ourselves" crap. and, my problem was random and never did it while they had it. so, i ended up just video taping the tack and you could tell by it and the audio what was going on. that was prove enough. Mitsu ended up having to buy it back from me.

all your past paperwork is a must if you ever decided to pursue this route.
