CAI -- downside?

CAI -- downside?
It's been reported here that folks achieve higher horsepower, and in many cases (when they lay off the fun pedal) increased fuel economy with various makers' CAI's. If this is truly the case, why doesn't Nissan deliver cars w/ intakes more similar to a CAI? Wouldn't they *love* to be able to claim higher mileage while providing more horsepower at the same time?
Is there something inherently bad about them, leading to engine problems or something?
Anyone?

Another downside is a possible lean condition. Without an ecu upgrade, it is possible that the ecu will not add enough fuel to compensate for the increased air flow. My dyno is in the dyno forum it is very lean with the Injen on. Hopefully, the knock sensor will prevent any damage from detonation but who knows if there is a long term effect?
