In re Hyundai and Kia Horsepower Litigation

Permission was asked for this information to be posted. Please do not veer off topic or turn this thread ugly. If so, it will be closed. I just found this interesting since us 02-03 owners were trying to have a class action suite filed against Nissan for overstating horsepower ratings.

The latest automotive manufacture finding itself paying up for overstating horsepower ratings is Hyundai Motor America and Kia Motors America. There were many law suits filed, which were then combined and renamed: In re Hyundai and Kia Horsepower Litigation.

Settlement Benefits: To settle the allegations in the Litigation concerning overstated horsepower ratings, Hyundai has agreed to give each class member who makes a valid claim either cash in the form of a prepaid Debit Card or a Dealer Shopping Card. The value of the Debit Card or Dealer Shopping Card depends on the type of vehicle, because the amount of the horsepower disparity was different for different vehicles. Class members are divided into four groups to reflect those differences.

Group A ................ $225 Debit Car or $325 Dealer Shopping Card
01-02 Santa Fe 2.4L, 01-02 Sonata 2.4L, 97-98 Sonata 2.0L ... These vehicles for which horsepower was overstated by 7.0% or more.

Group B ................ $150 or $240
96-97 Accent 1.5L, 02 Sonata 2.7L, 03 Tiburon 2.7L, 01 XG300 3.0L ... Overrated by 5.0-6.9%

Group C ................ $75 or $120
99 Accent 1.5L, 01-02 Santa Fe 2.7L, 99-01 Sonata with 2.5L, 03 Tiburon 2.0L ... Overrated by 4.0-4.9%

Group D ................ $50 or $100
99-02 Elantra 2.0L, 97-01 Tiburon 2.0L ... Overrated by 2.5-3.9%


They are looking at giving up quite a large sum of cash no matter how you look at it.

How much did Nissan overstate the HP on Maxima by? Wasn't it like 10% or more? I would love to get some money back because before I purchased my Max, I was basically comparing HP between different cars. I didn't know much about cars back then so I feel that they mislead me.

Don't get me wrong, I am very satisfied with Max's power but "artificially inflating" the HP number is not acceptable.

The mazda rx8 had the same problem only much worse they had to buy back the cars of the people that did not want to keep the cars, and gave life time warranty to the rest.

Yeah but they probably understated the torque so after you pay Nissan for the extra lbs-feet they gave you, you'll be back where you started.

that's why I am not really [i]that[/] mad at them... but they did use that "255HP" everytime they advertised on TV... that gave them unfair advantage over other car companys' ads. Of Course, I still love my Max... and love it everytime I am in front at a traffic light!

Does it mention whether only buyers of new vehicles from a dealership will be compensated, or if those that bought one of the named vehicles pre owned will be included as well (and how).

The 2002-2003 Maxima most likely made 245 hp and 265 tq, which is a difference of -10 hp from what the factory claimed and +19 tq from what the factory claimed. In all honesty, I don't want the extra 10 hp if I'm going to lose the tq...

I'd pick the Lifetime warranty. OMG 200,000 miles and something went wrong take it to the STEALER!! HAHA!!

Could you imagine? 20 years from now you bring it into the dealer to have your 17th rotary engine replaced under warranty!

I have no idea how Mazda is going to deal with that as well. If anyone ever complains about their perfromance engine being "unreliable", talk to a rotary owner.

Nope. Hyundai is a huge corporation of which Hyundai Motors is a division.
