so whats the diff in filters? beside the height, is one better then the other? because i bought a whole pack of the 65F00 a few months ago and still have some left

The smaller filter is the 65f00, which has been superceded to a new part # (not sure what it is). Go in the lubricants forum and ask bill99GXE about the 9E000

There is no difference in those filters the reason y they made the 65f00 is for clearance reasons --for the oil cooler on the vq35

At BMW we send all broken parts back to warranty dept. They are very strict about this. And if its a customer pay engine(or tranny) we will send that back too, for the customer will get about a $500 core discount towards the new motor.

100% incorrect. 65f00 is the "standard" filter and the 9e000 is a "premium" filter. There have been tests done to prove this. Also, the 9e000 fits perfectly in my 2k3.

Replace the pcv valve and do a compression test. This will help your case in getting the engine replaced.

In my case it was their automatic procedure, I went in 1000 miles after the oil change. Oil was low and I was in and out within 20 minutes, they told me I needed the new engine and made the request.

Try another dealer.
