She had to yeild. It's cut and dry here, there was no green arrow, green light. They turn yellow at the same time, If the witness saw red, then you both went through at yellow. Person taking left turn must yeild to oncoming traffic. Her story doesn't make any sense. Your light would have been red the whole time if her light had a green arrow. The light doesn't go red and then give the oncoming lane a green left turn arrow. Man this burns me up. If people make mistakes they should just own up to them.

Jess, you're fine. Fight the ticket and fight liability. Call your insurance and tell them you were involved in an accident, and you believe the other party is at fault. Tell them they failed to yeild while taking a left turn. From there, it's entirely up to your insurance if you could sue for liability. But this one isn't your fault.

Everyone drives about 10mph over the speed limit around here. Cops usually won't care unless you're 12 to 15mph over.

I was driving 35mph which is the speed limit so you're close.

Just made me laugh, because the first time I'm not speeding is the time I get into an accident.

Got an update for everyone...

What I'm afraid of is that well I may be wasting my time if I file claim, because no one has admitted fault. Also all stories do not add up, the judge may just say it's both our faults anyway in court.

Here's the accident report and as I thought the witness was not behind either of us.


Driver #1 = Volvo
Driver #2 = Maxima

V1 = Volvo
V2 = Maxima

Got to love police grammar.

Sorry to hear about your accident, hope it all works out. In either case, V1 is at fault for failure to yield, IMO.

I went up to her and asked if she was okay...we're both fine.

We're stuck in the intersection. I forget to take pics. I'm mad now for that.

Police come to the scene.

She said it was a green arrow.
I say it was yellow when I was half way through.

One witness says it was red for both...which doesn't add up with either of our stories.

We both got tickets for failure to stop.

ARGH I'm not mad as much as I feel bad for my poor girl. Got her all nice and fixed up to look good too.

Damn...

But I'm suprised she took the beating and handled well. The lady's headlight was smashed along with bumper and radiator bled it's green fluid. So good job on Nissan's part.

So far what needs to be done is...

Left Headlight (all plastic is cracked inside)
Left Foglight
Maybe replacement of a fender
Fender cover
Replacement of Bumper
Aligning hood
Radiator Support
Eyelid
Re-mod to Clear Lense

Stillen front Lip fell off, but otherwise unharmed! If it was fiberglass it wouldn't of made it.

They had to cut out the bumper and fender cover so that I could drive it home. Man what a day like I said you gotta be kidding me!

Another thing is when you go to court about the ticket to not have any points, dress really nice and go with your mom, it looks better.

oh and actually the county is partly responsible, there is no sign up saying to yield on green for left turns, even though driving 101 tells us you should yield, its in all the books for getting your permit, but the county needs to put one up asap

Damn, that really sucks. Glad to see that everyone is OK. Maybe you should consider getting a lawyer. I don't know how much a ticket like that would cost but you also have to keep in mind that your insurance rates are going to increase too. I don't really know how much it would cost for you to bring a lawyer though since I've never had the need for one.

Yes I know that she failed to yeild. But still we both got tickets based on the witness' account that we had both entered while we had red and she said her light was green.

I don't know how to get rid of her testimony if she said she had green....

I thought that maybe I could get together with the other driver and see if she will agree with me in writing that both lights were NOT red. But unsure if that is good enough to have the witness' story thrown out.

Also I'm too poor to get a lawyer lol, but it's not a huuuge deal. If people were hurt then yes I would get a lawyer.

she's not trying to get you to pay for her damages too is she? if not then just leave it as it is and just let each other go your own ways, i mean thank god nowadays everyone is so sue happy, you could continue to try and fight this thing but it could be 5 years before you see results and in the mean time what happens to your car, just get her back on the road...deal with the ticket later

Nope she's not which is why I'd just rather let things be. A couple people feel that the case is too complicated anyways. I may fight the ticket, but I'll deal with insurance on my own.

A person turning left into the path of another car is always assumed to be at fault unless they can *prove* otherwise. You have 3 stories that don't agree - but there are key points that you agree on - You were going straight and she turned left in front of you.

If you want to walk away then fine, you can do that. If it was me I'd fight it.


I know plenty of officers who take the attitude that if there is an accident and fault is not clear and everyone is telling a different story,t hen they will; 'cite everyone and let the insurance sort it out." The police do not want to become the de facto arbiters of complex accidents (where there is dispute) and will generally not cite just one person. It's all or nothing.

Well a small update...

I did get a little more from the insurance that will cover fixing the car up.

Sent a parts list over to DaveB and hopefully will get the car fixed within 2 weeks at the most.

The shop said they can get the car back to the way it was within 5 days. Just need to wait on getting parts, but at least I know I'm dealing with a reputable guy.

My girl is gonna be back and better than evah!
