What concerns me the most now is the construction of the maxima. From these pictures it is so obvious that had there been a passenger in the car there was a sure chance of someone getting injured.

After looking at these pics I went over to my 5th gen and actually saw the car from the side with both doors open. What surprises me is that the body structure of the car appears to be rather weak from the side which may have resulted in this. Imagine this car getting T-boned by say a Dodge or Ford truck. I would not even want to know the result.

I dont mean to bash anyone with this statement above but rather am just thinking out loud since my wife drives our maxima more than myself.
As someone else said, you may be right that the Max's are weak on the side, but the comparison is wrong. In this case the t-bone damage is on the driver's side, and that actually looks pretty good. On the passenger side, that's the result of a lot of mass and energy hitting a two-foot wide (or so) object, resulting in a lot of penetrating power.

In a t-bone, you have at least a five or six-foot wide impact, so the load is spread. My Max was hit from the side by some dolt in a Mustang, in a low-speed accident. It held up remarkably well.

So update as far as her insurance goes:

-they paid $13,xxx for my car, not bad considering i bought it for $9,xxx back in march 07.

-All medical bills are covered. They are compensating me two days of work that i missed. They also gave me a rental for a week.

-Lastly, ive been having some lower back problem. Ive never had it before and im only 20 so i don't want to have to live with this pain forever so im hopefully going to see a chiropractor today.

-Looks like im going to be buying a 02 TL-S.

One question, is it my responsibility to pay for the gas on the rental or is insurance company going to refund for it.

Do your research on that model of TL's. I know two guys with TL's that have had many trany problems. A good friend with a TL-S (think it's an 02) had his tranny swapped once at 18,*** miles and recently at 80,***. So do your research.

(Note: All three cars I mentioned above are automatics.)

the auto is totally different. the shift points are weird. it seems as if the car wants to shift but doesnt for some reason depending on the amount of pressure i have on the pedal. its weird, ill have to get used to it lol. ive never driven a 5.5 auto before this so it was really different. i dont think i will ever miss the torque. all in all im happy.

Yeah i know our cars expensive. It is always best to shop around. in this case you did and came out on top.

nk2k2: i just washed it Sunday. it looks clean from far away. when you get close to it then you see all the battle scars like the stone shipped front end.
thanks for the complement.

ive seen some pretty bad crashes in bmws.. (i work for bmw)and getting hit in the side..they do sustain less damage than ive seen most japanese cars. They are just built very well..but it does scare me sometimes to think what would happen if this happened to me..ive had 2 5th gens and now have a 6th gen..and the 6gen does feel moderately sronger and tighter..i still think the result in this crash would have been pretty dramatic. The 6gen does have side curtain airbags.. but i dont think it would have helped the passenger much..maybe the driver from hitting his head on the window or roof..and help prevent glass/parts from flying in. but i really hope nissan builds the 7th gen maxima well. if i like the way it looks..itll be my next car.

It seems like you didn't invest too much on the ride, so hopefully you are breaking even with the insurance check.

the other person was ticketed. i was going straight on green and she got ticketed for failure to yield on green. I have full coverage but her insurance company paid out for my car. I haven't come to a settlement yet. They paid 13k for the car, and i bought it for 9500 in 3/07 so i have a 3500 gain.

Not bad, usually the story goes the other way with insurance companies.
It's not to often you get more than you paid.

Exactly right. My 626 got totaled on October 23rd (bought an '02 Maxima SE to replace it) and even though I put $1500 worth of repairs into it since June, plus new tires, that only got me a $400 bump in the value of the car.

You don't have to take their first offer on the car and if you've had a lot of work done recently, they may bump you up a bit like they did me, but it definitely won't be anywhere near the full amount. I got less than 25% of what I had put into my car before it was wrecked. Looks like you came out pretty good though. My brother once bought a car with a salvage title for $12,000 and when it was totaled, insurance gave him nearly $15,000!

Glad to hear you weren't hurt, getting hit hard like that is pretty scarey (I was rear-ended and knocked from the right lane across the middle and left lanes and ended up on the left hand shoulder facing traffic) due to possible secondary impacts, like hitting the pole.

If you have any pain that lasts more than a day or two after the accident, you need to see a doctor and a lawyer. Not so much for an injury settlement but to prevent ending up with long term problems. Other than a stiff neck right after the accident, I felt pretty good but by the next day, my lower back was hurting pretty bad. I've been in therapy for 3 1/2 weeks now and am just noticing some improvement. I'd rather go through the therapy and have my back normal again than try to finish therapy too early and have problems 6 months down the road that I have to pay for.

but im thankful that im still alive and a lot more thankful that i didn't have a passenger. i couldn't live with the kind of guilt.
Sigh... you can not imagine the burden it is.

my wreck wasn't HORRIBLE but it still put my g/f in the hospital for 5 days b/c they weren't sure if the nausea/constantly vomitting was from the wreck or whiplash or emotional distress.....

she's getting better. I'm trying to talk her into physical therapy. she's just been going to the doctor and wears a brace (has a 30% compression fracture on her lower lumbar)
that was on July 18 and it's... nearly 4 months later. I want her out of that brace and doing better.

when she was in the hospital she blamed me for the wreck and all her pain....
That was probably the lowest part in my life so far (i'm only 21)

we were on our way to school at 7a.m. and roads were wet from the dew. . . .
driving on a backroad in town and low shoulder.... hit the grass and it was over after that.... hit a culvurt at probably 50mph i guess? (probably 5krpm in 2nd gear--not sure how fast that is)

some ppl have slandered that I can't drive after seeing the picture and well...
I really can't explain how far my depression went before I get pretty teary...
so I'll save that for another day.

Glad to see your all right and best of luck with the TL-S
