For those of you who are PMing me about getting parts off my old car, i can't. insurance has my car and i have do not have access to my old car. thanks.



So i had a pretty bad accident yesterday. I've never actually been in this bad of an accident. It happened around 7:50 am in Gainesville, VA. I was leaving my sisters house and i was on heathcole blvd traveling 45 mph and thats the posted speed limit. I know there are cops there so i didn't even bother. Ahead of my was the intersection of heathcole blvd and catharpin rd. The light on catharpin rd was red and the lights for heathcole were green with left lane to yield. I was going north on heathcole crossing over catharpin when i saw the Chrysler Sebring convertible coming in towards my drivers side. It happened in less an a second. I tried to swerve to miss her but it was too late. I was going about 40-45 and she must have been going 25-30 when she hit me but the force of her impact sent my car sliding and eventually hit the stoplight pole. I'm lucky to walk away with bumps and bruises. I'm thankful that i didn't have a passenger because the outcome would've a lot worse for them. I was taken to the hospital and checked out to make sure i didn't have any major injuries. I just had a 1st degree right shoulder separation. The car is totaled for sure. I'm looking into getting a TL-S. The car held up awesome and ultimately did what i wanted it to do and that was to save my life.

sure looks like one of the cars was going a lot faster that you said.
if she was going 25-30 and t-boned you, you would have slid and hit the poll at 20-25.
unless she hit you in the direction you were already going, then it would have been a higher speed.
the impact where she hit you doesnt look that bad....all the damage is on the poll side.

when the insurance company totals the car, they give you a check and now they own the car. you cant just take things off the car that you no longer own. if you take anything off before the insurance, your payment will be less. and dont try and tell them that parts like the headlights just "disappeared" in the collision. the insurance company sells it to a junkyard and they sell the parts.

aftemarket...maybe.
stock...not so much

thanks guys. im just sore and thats about it. i just got off the phone with the insurance company of the other drivers. looks like im not going to have any car until Monday because the appraiser will appraise the car on Monday. How do they appraise it? By BB value or something else? Also i just put new tires on it like last week, do i tell the appraiser about that when he/she calls Monday?

Nmexmax: i was thinking about getting a 02-03 TL-S. Im done driving stick. Its great and all but around here in NOVA were traffic is bad it sucks to clutch and shift all day. I know that those years have the tranny problems but im looking at one with 52,000 for 13k. Its a 02 w/ navi and stuff.

as far as new tires, from experience, the appraiser will say, "the value of the car will not go up with new tires since tires are a requirement"

Sorry to hear about the accident but I am glad you are ok. As for needing to tell the appraiser about things, it won't hurt but when my brother totalled my 95 GMC Jimmy a few years ago they noted everything pretty well, including that my tires SUCKED and took money off...so if you have brand new tires on there hopefully they notice that, otherwise I'd remind them. Good luck with the car search.

no i know that it probably not going to bring up the price of the car but will they refund me the 512 bucks that i paid for the tires last week?

also, what factors do they use to determain the value of the car?

My advice stay away..the tl-s and cl-s auto trannies for those years are made of glass. They are very delicate and break easily. Trust me...I was looking for one before and on the forums almost everyone is not on the original tranny...some people have went through 2-3 trannies. I know many who have had their trannies replaced and many not under warranty. You wont be able to enjoy the car and push it the way you want. Of course there are some who havent had a problem but only time will tell...my .02 and I hope you take my advice

if you have your reciept, they might, my uncle had his minivan totalled two days after he put a new tranny in it, the tranny was worth 1500, his van - 500, they gave him a check for 500, he went back with the reciepts and they gave him back the 1500.

talk to the appraiser, he will (at least he should) measure the thread depth on every tire, should be able to tell that they are brand new, the price won't go up as much on new tires as it would go down on bald tires. Ins. companies sell these cars at salvage auctions not junk yards, because they get alot more money at an auction.

i was surprised to see that much damage at reletively low speeds. I could only imagine what would be if it happened going 80-100. scary to even think about it, maybee i should slow down.

It would be physically impossible for the lady to hit him in the direction he was going if he was doing 45 ish and she was doing 25-30.......

i was actually thinking about buying the catmobile II but i decided that ive had a good run with the maxima for the last 6 months. Ive had the oil burning issue and SES lights here and there. Overall it was a great car. I might come back one day. Maybe for the 09 models lol? i dont know. we'll see. ive been eyeballing a 03 5.5 6spd thats local but it looks like its been beat on.

The appraiser uses Blue Book as well what the cars are actually selling for. Make sure you tell him/her about any upgrades and new stuff (like your tires).They will take that into consideration.

Remember, the insurance company does NOT want to go to court. (do you think they can find a jury where no one was screwed by their insurance campany?). You may have to fight and threaten court, but they have to "make you whole", which is the legal term and it's in their policy. That means they need to compensate you for YOUR car, including upgrades and new parts.

As I said, you may have to be a jerk, but it's your right. Don't sign off on any medical issues. You have a year to make sure you are OK before releasing the medical part. When I was hit, the other guy's insurance was playing hardball until I told them I may have hit my head. The check for the full amount I was asking came shortly after that!

I have a friend who had a specialty car (Datsun Roadster) that was totalled. He told the insurance company to find him another one. They spent almost 2 months looking and eventually gave him cash.

Don't roll over at the first offer. Get what it will take to replace YOUR car!!

hey tony thanks for the advice. yeah i talked to the ladies insurance company and the investigator told me she is going to mail me a form and for me to sign it saying that im "releasing" my medical history to them for them to compensate me for my hospital visit. i dont want to sign anything and get caught up in it. who should i consult about this? lawyer or my insurance agent? yeah i told them that i want to be compensated for two days of work missed and my rental ofcourse.

You will have to sign it to have insurance companies release your health records. It is standard procedure, they want to be sure you were not involved in a previous accident which resulted in bodily injury that may manifest itself differently in this accident.

This release of records is needed to be certain the level of compensation resulting from this accident. Don't settle with the claim but release the health records isn't harmful.

yeah the front window had cracks all throughout it. i thinki the tinted windows helped a lot from having glass hit me. the pass rear window had the tint fly off but all the glass what attached to the film. yeah its TL-S so im not going to miss out on that much power, mostly torque. ill be back one day lol. I just have to make sure the tranny on the TL has no problems or had any problems in the past.
