P0340 - recall? UPDATE 12-4, NEED (LEGAL) HELP

UPDATE ON POST #7

Hey guys,

This morning I was driving to my internship, and all of a sudden while going 40 mph my car just stalled and CEL went on. Than I tried to start it, and it took about 10 seconds for it to turn over, so I'm like WTF. My battery is only 2 years old, and according to my head unit (which has a battery meter) the battery is at 12.8v, so it's not the battery.

So I continue driving to my internship, and I noticed the car is acting very... rough and choppy. It's not accelerating as good and the acceleration is not smooth. Also, at low speeds, you can feel the car jerking forward. I was thinking wtf, this is a huge change from 20 mins ago when the car ran perfect.

So after the internship, I stopped by autozone and ran my codes, the code that came up was P0340 - Camshaft Position Sensor (Phase) Circuit (Bank 1). And there were 4 instances of this code.

So I reset the codes, and started driving. Once the codes were cleared, the car started fine, it ran fine, etc. Than 15 miles later again, stalled while driving. CEL came back, and all the problems came back.

So that's the desription of the problem, NOW THE QUESTION

Do you guys think it's related to the recall 03v455000 (http://www.lemonauto.com/complaints/nissan/maxima.htm)

Cuz the problems seems the same, but the recall is for a crank sensor, my codes were a camshaft sensor.

Do the 5.5 gens have this feature:

" The recalls involve only models using Nissan's "intelligent keys" with integrated circuit chips inside, which enable drivers to open their car doors with their keys still inside their pockets by just pressing on the handle. " - from the recall notice.

I didn't think they did so the recall won't apply. The only real way to determine if it does is to call up Nissan and ask. They will ask for the VIN which will tell them if your car is affected.

i was referring to the recall on the bottom of that site issued on 2003 regarding the crank sensor. obviously the 03 max's dont have the key feature.

I didn't think you read the site, so your comment on this post doesn't apply. Why don't you go find another person to try to make look like an idiot. I asked for legitimate help, not to be questioned.

Wow. I think that was uncalled for. I wasn't trying to make you look like an idiot. My mistake on reading your post incorrectly but I'm still right about calling Nissan. Not all recalls effect all cars even in the same model year. Nissan will know for sure by the VIN.

Had the same problem on my 03.

Part number 23731-6J90B Sensor Assy Mag 88.74
+ 195 Labor
=283.74.

This is on an 03 Max that at the time had 64,066 miles. I would've tried to do it myself, but didn't have the patience / time / knowledge. Car would stall at seemingly random intervals, several time each day. Would have to hold the key for an extended period of time to get the engine to turn over. Replaced battery last year, alternator / starter showed no signs of having issues. My car also through the P0340 code, and I showed the technician but they still had to charge me a $95 diagnostic fee...

UPDATE:

took it to the dealer, they are saying my cam shaft position sensors need to be replaced because they are faulty. Parts + Labor + Tax will be 490$. Now, it's not covered by my powertrain warranty, and they're saying my car is not recalled.

WTF, not recalled? How is that possible, here is the recall notice:

2003 NISSAN MAXIMA ENGINE AND ENGINE COOLING
Recall Date: 11/17/2003

Summary:
ON CERTAIN PASSENGER VEHICLES, THE CIRCUIT BOARD FOR THE CRANK POSITION SENSOR OR CAM POSITION SENSOR MAY HAVE AN IMPROPER SOLDER JOINT DUE TO SOLDER DEFORMATION CAUSED BY HEAT STRESS ACCELERATED BY THE EXISTENCE OF FLUX RESIDUE DURING THE SOLDERING PROCESS.
Consequence:
THIS COULD CAUSE THE "SERVICE ENGINE SOON" WARNING LIGHT TO COME ON, CREATE A NO START CONDITION, CAUSE REDUCED ENGINE POWER, OR CAUSE THE ENGINE TO STOP RUNNING WITHOUT WARNING DURING VEHICLE OPERATION, WHICH COULD RESULT IN A CRASH.
Remedy:
DEALERS WILL REPLACE THE CRANK POSITION SENSORS. CAMSHAFT POSITION SENSOR(S), AND IN SOME CASES, THE VARIABLE TIMING CONTROL SENSOR(S). VEHICLES INVOLVED IN A PREVIOUS RECALL CAMPAIGN, 01V357, ARE ALSO INCLUDED IN THIS NEW CAMPAIGN. THE REPLACEMENT SENSORS USED IN THAT CAMPAIGN ARE ALSO AFFECTED. OWNER NOTIFICATION BEGAN ON DECEMBER 22, 2003. OWNERS SHOULD CONTACT NISSAN AT 1-800-647-7261 OR INFINITI AT 1-800-662-6200.

Potential Units Affected: 630000

Notes: NISSAN MAXIMA R3021/R3022
I have the exact same problems with my car as this stupid recall, and the dealer says its "faulty" sensors... Gee, does it not sound like the recall? They say no, I called Nissan USA, they said my car is not involved... do you think it's a possibility they missed a few VINS, considering there are potentially 630,000 cars affected?!!

I need legal help, who do I call regarding this, BBB?

today I talked with the Nissan North America rep on the phone, and he called me "ridiculous" "unreasonable" and "unrealistic" because I am claiming that my car is affected by the recall.

How am I being any of those things? My car has the exact same issue as the recall, and my VIN number is only about a 1000 VIN numbers off... now don't you think that such a small number of cars off is bull****, considering that there are 630,000 cars affected?

if only the world ran that way and you always got your way.

need legal help, go get a lawyer. but you arent going to win this. the recall is specific and doesnt affect your VIN. you arent going to beat NNA on this.

for the record, if you are polite and respectful to the service manager and his staff...he will work with you. looks like you cant go that route now.

I know, I was very polite to the person, he kept calling me ridiculous and such. I asked to speak with his supervisor, the supervisor was nice, I've explained my situation calmly, explained this is the 2nd nissan in the family, and i was lookin too replace it after college, he understood the circumstances, he said he understands my concerns and sees it as completely reasonable that I can assume that my car is recalled, he said there's nothing that he can do, but he will take it to the customer satisfaction rep and give me a call later.

Also, I'm retarted, haha, I completely forgot that Vin = vehicle id number... so I'm saying number number... haha

You're not really retarded per-se, just not used to people who will romp on you for minor little things like that.............

Sorry to hear that, I fought with NNA for days on end it seemed regarding a major safety recall on my 300zx. Dealer claimed engine had been replaced with one from a different year that wasn't affected, which was BS. Yes, the engine had been replaced, but ALL Z31's were covered by the recall. To make a short post long........... They tried to deny, I fought and fought and fought and kept calling them and pissing them off and calling again and again and just acting like a 'tard asking them the same things over and over and for clarification and what not............

After enough of this, they finally said.......... "XXXXXX dealership will perform the work, give them my name & #, have a nice day Mr. Goodwin"
